Absent: Board Member Bawden.

The Board of Adjustment proceeded to review the terms of the variance.

Consensus of the Board of Adjustment was to amend #3 to read "That the property owner is
required to install one driveway onto 157th Lane of bituminous, concrete or Class 5, the entirety of
which must be located within the boundaries of the Subject Property. Also, the property owner
shall be responsible for providing the City with an easement onto the Subject Property for snow
storage and vehicle turn-around."

Mr. Barthold expressed concern over City vehicles getting stuck or damaging the driveway.

Board Member Holland assumed if the City enters private property, they are responsible for
damage to that property.

Mr. Jankowski explained that the pavement runs right up to the property line where there is
normally 15-17 feet right-of-way to push snow. He stated the City attempts to put snow where
there are no drives.

Board Member Deemer questioned whether the City wants a turn-around easement on 158th Lane
also.

Board of Adjustment/May 7, 1996
