Motion carded. Voting Yes: Chairperson Deemer, Board Members Thorud, Holland, Jensen, <br />LaDue, and Terry. Voting No: None. Absent: Board Member Bawden. <br /> <br />Mary Peterson, 6014 158th Lane ~ complained that she did not receive notice of this public <br />hearing. <br /> <br />Ms. Frolik explained that Ms. Peterson will have to contact Anoka County to determine why her <br />parcel was not included in the notification search obtained from Anoka County. <br /> <br />Don Cerwanka, 15835 Vanadium - inquired about the septic system. <br /> <br />Mr. Barthold advised that still needs to be done. <br /> <br />An unidentified member of the audience inquired as to who would be living on the property. <br /> <br />Mr. Barthold responded that either himself and/or his son will be residing on the property. <br /> <br />An unidentified member of the audience inquired as to when the City changed its policy allowing <br />Mr. Barthold to develop this property, questioning why he isn't any longer subject to 4 in 40 <br />density zoning. <br /> <br />Ms. Frolik explained the 4 in 40 density policy, however, advising that the property was brought <br />into the Municipal Urban Service Area with the last expansion. <br /> <br />Chairperson Deemer further explained that now the 40 acre parcel is in the Urban Reserve Area, <br />wherein the 4 in 40 density applies until sewer and water is extended to the area. <br /> <br />Ms. Frolik interjected stating that the property is not in the urban reserve, it is now in the MUSA. <br />Mr. Tollefson inquired as to the maximum number of lots that could be developed. <br /> <br />Ms. Frolik responded that in th MUSA, Mr. Barthold can have 40 1-acre lots without sewer and <br />water. If sewer and water comes in, he could have 3 lots per acre. Ms. Frolik went on to explain <br />that the City worked on this last MUSA expansion from 1993 to 1995 because they wanted more <br />vacant land within the MUSA boundaries to encompass more land for development. <br /> <br />Mr. Barthold declared "This variance is for one house, period. <br /> <br />Ms. Frolik explained that the MUSA expansion is the City's plan for future development of that <br />land. Development is inevitable. <br /> <br />Mr. Tollefson inquired whether drainage will be affected by this one house. <br /> <br />Mr. Barthold commented that his property is lower than Mr. Tollefson's property, and "water <br />don't run uphill." <br /> <br />Motion by Board Member Holland and seconded by Board Member Thorud to accept #1 through <br />#5 as presented. <br /> <br />Motion carried. Voting Yes: Chairperson Deemer, Board Members Holland, Thorud, Jensen, <br />LaDue, and Terry. Voting No: None.
