Chairperson Nixt introduced the following resolution and moved for its adoption: RESOLUTION tt04-09-276 RESOLUTION ADOPTING FINDINGS OF FACT #0699 RELATING TO A REQUEST FROM CAROLE WALSH FOR A vARIANCE TO CONSTRUCT A THREE-SEASON PORCH ADDITION THAT ENCROACHES ON THE ROGERS LAKE SETBACK. WHEREAS, Carole Walsh, hereinafter referred to as "Applicant," has properly applied for a variance from Section 9.21.04 (Shoreland Overlay District) of the Ramsey City Code to construct a three-season porch addition within the established Rogers Lake setback on the property generally known as 4849 179th Lane NW and legally described as follows: (A) That part of the north half of the northeast quarter of section 1, township 32, range 25, Anoka County, Minnesota, described as follows: Starting from the northeast comer of said section 1; thence south on east line of said section I a distance of 842.16 feet to center line of public road, thence south 82 ½ degrees west 403.6 feet to actual place of beginning; thence north and parallel with the said east line of section 1 for a distance of 597 feet; thence west and parallel with north line of said section 1 a distance of 150 feet; thence south and parallel with said east line of section 1 a distance of616.7 feet to said center line of public road; thence north 82 ½ degrees east 151.4 feet to place of beginning, also (b) That part of the northeast quarter of the northeast quarter of Section 1, Township 32, Range 25, Anoka County, Minnesota described as follows: Beginning at the northeast comer of said northeast quarter of the northeast quarter; thence south on the east line thereof 442.16 feet to a point 400 feet north of the intersection of said east line with the center line of town road; thence west at right angles 300 feet; thence south at right angles 439.5 feet to centerline of said town road; thence south 82 ½ degrees west on said center line of town road 100.9 feet; thence north and parallel with said east line of northeast quarter of the northeast quarter 894.84 feet, to north line of said northeast quarter of the northeast quarter; thence east 400 feet to place of beginning, excepting from tract (b) that part described as follows: beginning at the northeast corner of said northeast quarter of northeast quarter of section 1, township 32, range 25; thence south along the east line of said northeast quarter of northeast quarter 442.16 feet; thence west at right angels a distance of 300 feet; thence north and parallel with the east line of the northeast quarter of the northeast quarter 442.16 feet more or less to the north line of section 1; thence east along the north line thereof to the point of beginning, also (c) That part of the north half of the northeast quarter of Section 1, Township 32, Range 25, Anoka County, Minnesota described as follows:
