Record ID 1544128 4823O9.OO9 Cotmcihnember Cook introduced the following resolution and moved for its adoption: RESOLUTION #04-12-388 A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO RAMDANCE, LLC TO OPERATE A RESTAURANT DRIVE-UP WINDOW AS PART OF THE POND BUILDING IN RAMSEY TOWN CENTER 3lm ADDITION IN THE TC~2 ZONING DISTRICT AND DECLARING TERMS OF SAME: WHEREAS, Ramdance, LLC, hereinafter referred to as the "Pemittee," has properly applied lbr a Conditional Use Permit to operate a restaurant drive-up window as part of the Pond Building in Ramsey Town Center 3rd Addition in the TC-2 Zoning District on property legally described as follows: Outlot I, Ramsey Town Center Addition, Anoka County, Minnesota; Or upon recording I,ot 1, Block 1, Ramsey Town Center 3ra Addition. (%ubj ect Property") WHEREAS, the Planning Commission met on December 2, 2004, conducted the public hearing and recommended City Council approval of the request. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: Based on Findings of Fact #0711, a Conditional Use Permit (Permit) to operate a restaurant drive-up window as part of the Pond Building in Ramsey Town Center 3rd Addition in the TC-2 Zoning District, is hereby granted to the Permittee. '/'hal the Permit allows for one (1) drive-up window on the Pond Building restaurants to be located on the proposed Lot 1, Block 1 of Ramsey Town Center 3rd Addition. 3 That the Permit only allows for the use of the drive-up window to support restaurant operations contained within the Pond Building. That the types of tenants allowed to occupy the unit with the drive-up window shall be one that requires minimal drive-up activity, such as a coffee shop, and shall not include "fast food r3staurants .
