During the discussion of
the variance it was learned there was a dispute as to the location of the common property line
between Mr. McChesney and his neighbor to the south, and consequently, the Board also granted
a 5 foot variance to the 10 foot side yard setback on the south property line. Ms. Frolik advised
that upon having the property surveyed, it has been determined that one comer of the accessory
structure will be 4.5 feet from the side property line and the other comer is 3 feet from the side
property line. She explained that the accessory structure is a rebuild of a former structure and
consequently a substantial amount of framing is in place. Ms. Frolik also advised that the
neighbor, Mr. Wall, was disappointed when Mr. McChesney was granted the 5 foot variance and
does not feel he should receive another variance. She added that Mr. Wall is concerned that the
green siding on the present structure should be removed.

Board of Adjustment/February 1, 1994
