<br />ORDINANCE # 08-08 <br /> <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AN INTERIM ORDINANCE FOR A MORATORIUM ON CONDITIONAL USE PERMITS <br />FOR THE CONSTRUCTION OF CELL TOWERS WITHIN THE CITY OF RAMSEY, <br />ANOKA COUNTY, MINNESOTA <br /> <br />The City of Ramsey Ordains: <br /> <br />SECTION 1. AUTHORITY <br /> <br />This Ordinance is adopted pursuant to that authority granted to the City by MSA 462.355, Subd. 4, <br />entitled "Interim Ordinance." <br /> <br />SECTION 2. PREAMBLE AND PURPOSE <br /> <br />WHEREAS, on January 8, 2008, City Council directed staff to prepare an interim ordinance for a <br />moratorium on Conditional Use Permits (CUP) to construct cell towers in the City of Ramsey in <br />order to study alternatives to current tower regulations; and <br /> <br />WHEREAS, the City Council finds that Section 9.15 of the Zoning Code relating to 'Towers' is <br />currently insufficient in terms of height requirements and placement of said towers; and <br /> <br />WHEREAS, Section 9.15 of the Zoning Code is in need of additional updating since the adoption <br />of the Public/Quasi Public Zoning District; and <br /> <br />WHEREAS, 'Antennas', as defined in Section 9.15 of the Zoning Code, will continue to be <br />allowed to be attached to existing structures and towers and will not be affected by the interim <br />ordinance; and <br /> <br />WHEREAS, the City Council finds that an interim ordinance for a moratorium on CUPs for the <br />construction of cell towers within the City of Ramsey, except those specifically excluded below, is <br />necessary to protect the planning process and the health, safety and welfare of the citizens of <br />Ramsey. <br /> <br />WHEREAS, the City Council finds that it is necessary for City Staff to study the above referenced <br />issues and to present to the City Council their study and recommendations for changes to the said <br />section 9.15 of City Code. <br /> <br />SECTION 3. STUDIES <br /> <br />The City Council directs City Staff to study the issues raised in Section 2. above and to report back <br />to the City Council when the study is completed and present recommendations to the City Council <br />for possible amendments to Section 9.15 of City Code <br /> <br />Ordinance #08-08 <br />Page 1 of3 <br />
