<br />Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #08-01-024 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0820 RELATING TO A <br />REQUEST FROM MICHAEL BEACH FOR AN INTERIM USE PERMIT TO <br />CONTINUE TO OPERATE A HOME HEALTH CARE BUSINESS ON THE <br />PROPERTY LOCATED AT 7830 149TH LANE NW. <br /> <br />WHEREAS, the City of Ramsey received an application from Michael Beach for a home <br />occupation permit to continue to operate a home health care business on the property generally <br />known as 7830 149th Lane NW, and legally described as follows: <br /> <br />Lot 5, Block 1 Greenland Hills, Anoka County, Minnesota, subject to easement as <br />shown on plat <br /> <br />(the "Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />1. That on November 30, 2007 Michael Beach, hereinafter referred to as "Applicant", <br />properly applied for a home occupation permit to operate a family-run home health care <br />business within his home. <br /> <br />2. That the Applicant appeared before the Ramsey Planning Commission for a public <br />hearing pursuant to Section 9.03.05 of the City Code on January 3, 2008 and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br /> <br />3. That the Subject Property is zoned R-1 Single Family Residential (Central Rural <br />Reserve). <br /> <br />4. That the Subject Property is approximately 1 acre in size. <br /> <br />5. That home health care businesses are not a permitted use in the R-1 Single Family <br />Residential District without a Home Occupation Permit. <br /> <br />6. That the Applicant has provided documentation that the business has been operating out <br />of the home since 1990, and has been properly licensed by the State of Minnesota since <br />that time. <br /> <br />7. That the Applicant has stated that around 1990, Jerry and LeeAn Beach consulted City <br />Staff prior to establishing the business and were informed that a special permit was not <br />needed. <br />
