PUBLIC HEARING <br /> PLANNING AND ZONING COMMISSION <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br /> STATE OF MINNESOTA <br /> <br />The Rams~.r~ Pla~ ning and Zoning Commission conducted a public hearing on Tuesday, January 7, <br />1992 at th[ Ra~sey Municipal Center, 15153 Nowthen Boulevard N.W., Ramsey, Minnesota <br />55303 to h~a~r the proposed amendment to City Code Chapter 9.12 "Signs". <br /> <br />Members Pr~sertt: Chairman Gerald Zimmerman <br /> Commissioner David Bawden <br /> Commissioner Benjamin Deemer <br /> Commissioner Terry Hendriksen <br /> Commissioner Charles LaDue <br /> Commissioner Bradley Thorud <br /> <br />Also Presen <br /> <br />Members Ab, sent: <br />CALL TO ~ORDER <br /> r. <br /> <br />Zoning Administrator Sylvia Frolik <br /> <br />Commissioner Michael Terry <br /> <br />Chairman zi;mmerman called the public heating to order at 7:38 p.m. <br />CITIZEN ilNPUT <br />Willie Profti Cqntral Sign Company, Ramsey - stated he has been the owner, operator and only <br />employee o~ the. Central Sign Company for approximately 30 years. He added he is retiring so the <br />sign chaptetSdoOsn't really pertain to him; however, since the subject is near and dear to his heart, <br />he felt coml~lle~_, to speak on the subject. He feels the purpose and function of local government is <br />to protect ~ rights, health and welfare of the citizens it governs· He stated he was not sure if the <br />state chart'eir e~powers municipal government and he knows the power to govern is limited; <br />however, th~ City cannot violate civil rights. He's curious as to who suggested an amendment to <br />the sign chapter[ and when this all came about. He thinks it's the people in authority who are <br />opposed to~ignls and the reason for the opposition is that they may not be aesthetically pleasing. <br />He feels thai~ a gerson's First Amendment tights should supersede any aesthetic judgement and just <br />because thb ~ityt Council passes an ordinance, it does not make it constitutional. He feels the City <br />is prohibi~ng ad?ertising signs. <br />Commissiot~er Deemer replied that the proposed Sign Ordinance does not prohibit advertising <br />signs <br /> <br />Mr. Proft ¢6rnrrt~ented that the proposed Sign Ordinance states you have to have a permit for signs <br />and in the IJInitd:fi States you have a right to free expression; it does not say you have a tight to free <br />expressiort ~ut Y~ou have to pay a fee for it. He stated he has read articles about court cases against <br />cities and inisome cases, the courts have decided that cities have overstepped their bounds. <br />Zoning Adrgin[strator Frolik assured Mr. Proft that City Attorney Goodrich is reviewing the <br />proposed or4tina[~ce on that aspect; the First Amendment and the freedom of speech. <br />Chuck De! ~a?eyi Armstrong Ranch Kennels, Ramsey - inquired how billboards are regulated on <br />Highway #~0. <br /> <br />Public Hearing/Planning & Zoning Commission/January 7, 1992 <br /> Page 1 of 3 <br /> <br /> <br />
