Mayor Ramsey introduced the following resolution and moved for its adoption: <br />(the "Subject Property") <br />RESOLUTION #11 -01 -023 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0882 RELATING TO A <br />REQUEST FROM LEON RICHTER FOR A CONDITIONAL USE PERMIT FOR AN <br />OVERSIZING OF AN ACCESSORY BUILDING ON A SINGLE PROPERTY. <br />WHEREAS, the City of Ramsey received an application from Leon Richter on October <br />22, 2010 for a conditional use permit to exceed the total amount of accessory structure space <br />permitted on the property generally known as 8150 144 Ave NW and legally described as <br />follows: <br />Lot 1, Block 4 Alpaca Estates 3 Addition, Subject to Easement of Record. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br />1. That on October 22, 2010, the Applicant properly applied for a conditional use permit (the <br />"Permit ") to build a 2,576 square foot accessory structure (the "Structure ") to exceed the <br />amount of accessory structure square footage allowed by City Code Section 117 -349 by <br />1,052 square feet (1,080 square feet [existing] + 96 square feet [existing] + 2,576 square <br />feet [proposed] = 3,752 square feet [total proposed] — 2,700 square feet [allowed]). <br />2. That the Applicant appeared before the Ramsey Planning Commission for a public <br />hearing pursuant to Section 117 -50 of the City Code on December 2, 2010 and that said <br />public hearing was properly advertised and that the minutes of said public hearing are <br />hereby incorporated as a part of these findings by reference. <br />3. That the Subject Property and surrounding parcels are zoned R -1 MUSA and located <br />partially in the Critical Area Overlay District. <br />4. That the Subject Property is approximately 2.70 acres in size. <br />5. That Section 117 -349 of the Ramsey City Code states that on parcels of land of this size, <br />the total square footage of the main garage and all accessory buildings shall not exceed <br />2,700 square feet and that oversizing of accessory structures is a conditional use under <br />City Code Section 117 -111. <br />6. That the Structure is proposed to be located in the rear yard. <br />
