BOdle Peter Raatikka~ City Er, g. <br /> Kenn~th'ipeterson - arrived at 8:45 p.m. <br /> <br />Motion by Ron ~est, second~,d by Gerry Zimmerman to approve the minutes of <br />December 5, 1977 as read. 5 ~yes, Brad Bodle abstained. <br /> <br />Item 1. Ken<Barthel e:~plained <br />that since he understood t~e ~eszdents dmd not ~,ant a public access that he <br />had his attorney check int~ ~rivate'access and that there would not be any <br />problem. Art Du.nn asked, i~ the access problem had been thoroughly discussed <br />by the residents. Carol A~d~easen, 5510 164th Lane N.W.~ stated_ that she had <br />alraady contacted her insulate Carrier to determine the liability connected <br />with s private access and ~as~ informed that the owner of the actual piece of <br />oro~erty was liable. A1 S~r~e~ berg stated that this question of access would <br />be a oriv~.te matter between. ~he residents and the developer. <br />Pete Raatikka read the eng~n~er, s report and exolained that certain lots <br />would be unbuildable due t~' ~igh Water table. ~t was determined that these <br />low lots would require apo$o~i~atelY 3 - 4 feet of fill. Art Dunn asked if <br />fi'Il could be made available ?rom within the olat and stated that since there <br />ws.s no guarantee that Bart~e~ wOUld be the builder for all_ the lots the only <br />so].ution would be to requi~e jthese low lots be filled prior to final avproval <br />of olat. Ken Barthel answered that this requirement would limit buyers to <br />where a home could be situated and he felt the matter could be handled through <br />restrictive covenants.on t*e'~deed stating that these lots be brought up to <br />e×ist~n? ordinance requireSe~ts before construction. Ken Barthel explained <br />that since these lots were~'.p~esently heavy wooded that if he removed the <br />necessary organic matter a.~d~trees to fill at this time there would be a <br />severe errosion problem ChitS, ese.lots mf not buzlt on zmmedmately.
