He Wants to sub~i'Vi'de 33 acres out of an 80 acre tract of land by
metes and bounds. This ar~a is located in the NW 1/4, Sec. 9, T32-R25, and the
NE 1/4 Sec. 8, T32-R25, neDr County Road 63 and Bison Street NW. This area was
drafted and presented to the Planning & Zoning Commission as a preliminary plat
called "Scott's Gardens" ih mid-1976.

Discussion centered aroundI the fact that Bison Street is not a dedicated public
street and is not brought Dp to city standards as shown in the city engineer's report,
also problems dealing withithe long easement into the property from Bison Street N.W.
A1Sorteberg expressed con~ern of future liabilities of the City if a building
permit were issued, such aD School bus service, grading, utilities, etc. Some
members of the Commission ~ho.ught that leaving the 33 acres as one tract of land
might be the best use of the land because much of the land is low and unbuildable.

Tom Moorhouse moved to recpmmend to the City Council to grant a variance to Dennis
'~emple to subdivide by metes & bounds the 33 acres because it is the best use of the
land.
