Board Member Johnson introduCe:d the folloWing: resolution and moved for its adoption: <br /> REsoLUTION #05-01-003 <br />RESOLUTION ADOPTING FINDINGS ;OF FACT #0713 RELATING TO A REQUEST <br />FOR A VARIANCE TO T',I'tE MAXI. MUM FRONT YARD SETBACK FOR THE <br />RAMSEY MUNICIPAL FACILITY IN THE TOWN CENTER ZONING DISTRICT, <br />SUBDISTRICT TC-1. <br /> <br /> WHEREAS, the City of:Ramsey~i hereinafter referred to as "Applicant," has properly <br />applied for a variance from Section 9.20.25; Subd. 3.b, regarding minimum and maximum front <br />yard setbacks in the TC-1 sub-district of the Town Center District, on the property legally <br />described as follows: <br /> <br />Outlots S, T, X, Y and Z, Ramsey Town Center Addition, Anoka County, Minnesota <br /> <br />(the "Subject Property) <br /> <br />NOW THEREFORE, BE IT REsoLVED By THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. That the Board o£ Adjustment conducted a Public hearing pursuant to Section 9.03.07 of the <br /> Ramsey City Code on January 6, 2005; and ihat said public hearing was properly advertised, <br /> and that the minutes of said public hearing' are hereby incorporated as a part of these findings <br /> by reference. <br /> <br />2. That the Subject Property is zoned TC-1 Town Center Mixed Use Core. <br /> <br />3. That properties to the east, West, and north are zoned TC-1 Town Center Mixed Use Core. <br /> <br />4. That the Subject Property is bounded on the south by the Burlington Northern Santa Fe <br /> Railroad. <br /> <br />That section 9.20.25, Subd. 3.b, establishes a minimum from yard setback of 0 feet and a <br />maximum structure setback of 5 feet With'the requirement that at least 60% of the front <br />fagade is within the setback area. <br /> <br />That the Applicant is requesting a variance from the five foot maximum front yard setback in <br />order to construct the RamseYMuniCipat Center as shown on the preliminary site plan dated <br />November 15, 2004. <br /> <br />7. That the Applicant has stated the variance requested is the minimum variance needed to <br /> alleviate the hardship. <br /> <br /> <br />
