Councilmember Reimann introduced the following resolution and moved for
its adoption:

RESOLUTION #81- 15

WHEREAS, Charles H. Olson and Connie Olson are the owners of
the following described property:

The Southeast Quarter of the Northeast Quarter and the
West 66 feet of the East 528 feet of the Northeast
Quarter of the Northeast Quarter all in Section 4,
Township 32, Range 25.

and

WHEREAS, John Brolsma and Lorraine Brolsma desire to purchase
the above described parcel and construct a home; and

~tEREAS, the parcel does not have 200 foot frontage on a
public road as required by City Code, but rather it has only 66 foot
of public road frontage; and

WHEREAS, the 66 foot tract above described was subdivided con-
trary to the City Code and State Law; and

WHEREAS, the City Council finds that the 40 acre tract is land-
locked except for its 66 foot wide access and it is almost impossible to
get a 200 foot of public road frontage for this 40 acre tract because of
previous development adjacent to it; and

WHEREAS, the landowner and proposed purchaser have applied to
the City for a varianee from the City Code such as to allow a building
on less than 200 foot frontage and a variance to the City's subdivision
code such as to allow the 66 foot tract to be created by metes and
bounds; and

WHEREAS, the City Council finds that to deny the building per-
mit and variances would create an unnecessary hardship on the parties
involved, name of whom created the circumstance.

NOW THEREFORE, IT IS HEREBY RESOLVED, as follows:

1) That a variance is hereby granted such that the 40 acre
parcel above described may receive one residential building permit, not
withstanding that it does not have 200 feet of public road frontage.

2) That the West 66 feet of the East 528 feet of the North-
east Quarter of the Northeast Quarter of Section 4, Township 32, Range
25, may be subdivided by a metes and bounds description and made a part
of the above described 40 acre parcel such that the 66 foot wide parcel
and the 40 acre parcel become one parcel for legal description and tax
record purposes.
