Councilmember Van Wagner introduced the following resolution and moved <br />for its adoption: <br /> <br />RESOLUTION ~84-8 <br /> <br /> WHEREAS, NDH, Inc. has applied to the City for a Planned Unit <br />Development (PUD) final approval and for PUD zoning by an application dated <br />November 15, 1983 both for the following described property, to wit: <br /> <br />That part of the south half of the Southwest Quarter and of <br />Government Lot 3, Section 25, Township 32, Range ZS, Anoka <br />County, Minnesota, lying easterly of the plat of Flintwood Hills <br />and lying westerly of the center line of State Highway ~47 <br />as now laid out and traveled. Except that part described as <br />follows: Beginning at the southwest corner of said Government <br />Lot 3; thence westerly on the southerly line of said Southwest <br />Quarter a distance of 82.5 feet; thence northerly at right angles <br />to said southerly line of said Southwest Quarter a distance of <br />Z91.43 feet; thence easterly parallel with said southerly line <br />of said Southwest Quarter, to the center line of said State <br />Highway ~47; thence southeasterly, along said center line of <br />said highway, to the southerly line of said Government Lot <br />3; thence westerly along said southerly line of said Government <br />Lot 3 to the point of beginning. <br /> <br />And, Outlot 1, Flintwood Hills, Anoka County, Minnesota. <br /> <br />And that part of the Northwest Quarter of the Northwest Quarter <br />of Section 36, Township 3Z, Range Z5, Anoka County, Minnesota, <br />lying northerly of the center line of County Road #116 as now <br />laid out and traveled and lying southerly and easterly of the <br />plat of Flintwood Hills and lying easterly of the westerly 660.0 <br />feet thereof as measured parallel with the north line. <br /> <br />PIN R-ZS-3 Z-ZS-33-0020/0742094 <br />and R-Z5-3 Z-Z5-34-0001/0734156 <br /> <br />; and <br /> <br /> WHEREAS, the City's Planning and Zoning Commission held a public <br />hearing on the application on November zg, 1983; and <br /> <br /> WHEREAS, the City Council held a public hearing on the PUD application <br />on January 10, 1984; and <br /> <br /> WHEREAS, the applicant had not provided the necessary information <br />to either the Planning and Zoning Commission or the City Council prior to their <br />respective hearing, such as to permit the Council to consider preliminary <br />development plan approval of the PUD; and <br /> <br /> WHEREAS, the requirements of the City Code, Section 170.014G must <br />be met prior to the City granting preliminary development plan approval; and <br /> <br /> WHEREAS, the City Council, after it receives the data required by Section <br />170.014G of the Code must then conduct a public hearing in order to grant <br />preliminary development plan approval; and <br /> <br />Resolution ~84-8 <br />Page 1 of Z <br /> <br /> <br />
