ORDINANCE//01-15 CITY OF RAMSEY ANOKA COUNTY STATE OF MINNESOTA AMENDMENT TO CHAPTER 9 OF THE CITY CODE, WHICH CHAPTER IS KNOWN AS THE ZONING AND SUBDIVISION OF LAND CHAPTER OF THE CITY CODE. AN ORDINANCE AMENDING SECTIONS 8.01.03(c), 9.11.18(3)(c), and 9.50.03(2)(c)(7) OF THE CITY CODE OF RAMSEY, MINNESOTA. The City of Ramsey ordains: SECTION 1. AMENDMENT Subsection 8.01.03 Permits, Inspections, and Fees is amended to include the following text: (c) Elevation Survey. At the time of a footing and foundation inspection is done, the builder or applicant shall produce a certified elevation survey verifying that the elevation of the foundation conforms to the overall grading plan for the area. Failure to produce such certified elevation survey will lead to delays in approving the footings and foundations. This requirement may be waived at the discretion of the City. Engineer if it is determined that the certified elevation survey is not needed to ensure the compatibility, of the grade of the lot with the overall grading and drainage plan for the area. Subsection 9.11.01(13) Performance Standards - General Requirements is amended to include the following text: (13) The grade of existing lots with approved grading plans shall not be modified except after review and approval by the City, Engineer. Subsection 9.11.18(3)(c), Grading, Mining, Filling Permits - Exceptions is amended to read as follows: Grading of individual residential lots by less than three (3) feet in depth, filling of less than two (2) feet at any point and which does not interfere with surface drainage in the area and does not substantially change the approved grading plan for the area. These standards can be exceeded without a Conditional Use Permit if the proposed excavation is for the purpose of creating a pond providing the pond created has a water surface area of one-third acre or 20% of the total lot size, whichever is less, and the excavated material is hauled off-site or does not alter the drainage paterns of ad|acent properties. This addition does not relieve the proper~ owner from acquiring the permits that are required from other agencies that have jurisdiction of wetlands and protected waters of the State of Minnesota. The Minnesota Department of Natural Resources, Lower Rum River Watershed Management Organization, Board of Water and Soil Resources, US Army Corpses of Engineers and the Anoka Conservation District should be contacted as well. Subsections 9.11.18(4) Definitions and 9.11.18(5) Administration are amended to replace all references to "conditional use permit" with the term "interim use permit".
