ORDINANCE #89-3 <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE LICENSING AND <br />REGULATING THE SALE AND <br />CONSUMPTION OF "ON-SALE" <br />INTOXICATING LIQUOR, REPEALING <br />INCONSISTENT ORDINANCES AND CITY <br />CODE PROVISIONS, AND PROVIDING A <br />PENALTY FOR VIOLATION. <br /> <br />The Council of the City of Ramsey ordains: <br /> <br />130.051 PROVISIONS OF STATE LAW <br /> ADOPTED <br />The provisions of Minnesota Statutes Chapter <br />340A relating to the definition of terms not <br />defined herein, licensing, consumption, sales, <br />financial responsibility of licensees, hours of <br />sale, and all other matters pertaining to the <br />retail sale, distribution, and consumption of <br />intoxicating liquor, are adopted and made a <br />part of this chapter as if set out in full. <br /> <br />130.052 REQUIRED LICENSE <br />1. On-sale liquor license. <br /> No person, except wholesalers or <br /> manufacturers to the extent authorized <br /> under state license, shall directly or <br /> indirectly deal in, sell, or keep for sale <br /> any intoxicating liquor for "on sale" sale <br /> without first having received a license <br /> to do so as provided in this section. "On <br /> sale" licenses shall be issued only to: <br /> a. hotels; <br /> b. restaurants; <br /> c. bowling centers; <br /> d. clubs or congressionally chartered <br /> veterans organizations provided that <br /> the organization has been in existence <br /> for at least three years and liquor <br /> sales will only be to members and <br /> bona fide guests. <br /> All of the above as defined hereinafter. <br /> <br />2. Sunday on-sale liquor license. <br /> Special on sale licenses for the sale of <br /> intoxicating liquor on Sunday shall be <br /> issued only to hotels, bowling centers, <br /> restaurants and clubs as defined in this <br /> chapter. All sales of liquor by such <br /> establishments shall be in accordance <br /> with M.S.A. 340A.504, Subd. 3. <br />3. Temporary 0n-~ale license. <br /> The City shall not issue temporary on <br /> sale licenses. <br /> <br />130.053 DEFINITIONS <br />The following terms have the <br />ascribed to them in this section. <br />1. Alcoholic beverage. <br /> <br />meanings <br /> <br />"Alcoholic beverage" is any beverage <br />containing more than one-half of one <br />percent alcohol by volume. <br />Bowling center. <br />"Bowling center" is a business <br />constructed as and used for the primary <br />purpose of bowling, and which business <br />establishment actually contains bowling <br />alleys, pinsetters, and all other <br />equipment necessary for bowling activity <br />and which has a market value, including <br />land, building, and fixtures, of at least <br />$200,000 as appraised by the City <br />Assessor. A business shall not be <br />considered a "bowling center" where the <br />only type of bowling available is through <br />the use of coin operated amusement <br />devices. <br />Club. <br />"Club" is an incorporated organization <br />organized under the laws of the state for <br />civic, fraternal, social, or business <br />purposes, for intellectual improvement, <br />or for the promotion of sports, or a <br />congressionally chartered veterans' <br />organization, which: <br />a. has more than fifty (50) members; <br />b. has owned or rented a building or <br /> space in a building for more than one <br /> (1) year that is suitable and adequate <br /> for the accommodation of its <br /> members; <br />c. is directed by a board of directors, <br /> <br /> <br />
