ORDINANCE #89-8 <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE LICENSING AND REGULATING THE SALE OF "OFF-SALE" <br />INTOXICATING LIQUOR, REPEALING INCONSISTENT ORDINANCES AND PROVIDING A <br />PENALTY FOR VIOLATION. <br /> <br />The City of Ramsey ordains: <br /> <br />I 30.05 1 PROVISIONS OF STATE LAW ADOPTED <br />The provisions of Minnesota Statutes Chapter 340A relating to the definition of terms not <br />defined herein, licensing, consumption, sales, financial responsibility of licensees, hours of <br />sale, and all other matters pertaining to the retail sale, distribution, and consumption of <br />intoxicating liquor, are adopted and made a part of this chapter as if set out in full. <br /> <br />REQUIRED LICENSE <br />1. Off-sale liquor license. <br /> No person, except wholesalers or manufacturers to the extent authorized under state <br /> license, shall directly or indirectly deal in, sell, or keep for sale any intoxicating liquor <br /> for "off sale" sale without first having received a license to do so as provided in this section. <br /> "Off-sale" licenses shall be issued only to drug stores and exclusive liquor stores and shall <br /> permit "off-sales" of liquor only. No "off-sale" license shall be issued to the "on-sale" <br /> liquor licenses. The City may issue a maximum of three (3) "off-sale" licenses. <br /> <br />DEFINITIONS <br />The following terms have the meanings ascribed to them in this <br />1. <br /> <br /> section. <br /> Alcoholic beverage. <br /> "Alcoholic beverage" is any beverage containing more than one-half of one percent alcohol <br /> by volume. <br />2. 0~ty. <br /> "City" is the City of Ramsey, Anoka County, State of Minnesota. <br />3. .City Council. <br /> "City Council" is the City Council of the City of Ramsey, Minnesota and is also referred to as <br /> "Council". <br />4. Exclusive liquor store. <br /> "Exclusive liquor store" is an establishment used exclusively for the sale of intoxicating <br /> liquor except for the incidental sale of ice, tobacco, nonintoxicating malt liquor, beverages <br /> for mixing with intoxicating liquor, soft drinks, cork extraction devices, and books and <br /> videos on the use of alcoholic beverages in the preparation of food, and the establishment <br /> may offer recorded or live entertainment. <br />5. Intoxicating liquor. <br /> "Intoxicating liquor" is ethyl alcohol, distilled, fermented, spirituous, vinous and malt <br /> beverages containing more than 3.2 percent of alcohol by weight. <br />6. Licensed premises. <br /> "Licensed premises" is the premises described in the approved license application. <br /> <br /> <br />
