A UT~ORITY <br />This Ordinance ii} ad~pted pursuant to the authority granted by Minnesota Statutes, Chapter 349. et al. <br />SECTION 2. NDMENT <br />Section 7.61 of City Code is amended to read as follows: <br /> 7,61.0ti P~rpose <br /> <br /> The purpo~se ~f this section is to regulate and control the conduct of charitable gambling pursuant to <br /> the provis!on~ of Chapter 349 of Minnesota Statutes. <br /> <br /> 7.61.02~ ~option of Reference <br /> Chapter .~3~ 9 [ <br /> o~ Minnesota Statutes is adopted by reference the same as if fully set forth herein. <br /> 7.61.03 N~ptice; Approval or Disapproval <br /> The appl :ant~ for a charitable gambling license within the City of Ramsey shall notify the City <br /> Council', t w~iting in the manner required by law of each pending a~pplication for a charitable <br /> gamblin~ .ice~)se at least 60 days before issuing or renewing the license. Each pending application <br /> for a lice ,;e sl~all be approved or disapproved by the Ramsey City Council. <br /> <br /> 7.61.04 L~cation <br /> Lawful g~,mbiing under license issued by the Minnesota Charitable Gambling Control Board <br /> ("Board'S) ma~ be conducted only at locations that comply with applicable zoning, building, f~re <br /> and health co~es of the City of Ramsey. All applications must be for a specific location with the <br /> exceptio~ >f ~lass D (raffle only) licenses. <br /> <br /> The following locations are considered unsuitable for gambling operations and any request for a <br /> charitabl~ ~ar~o~-i ling license at such a location will be rejected without clear and convincing evidence <br /> that such a l~cation will not pose undue enforcement difficulties, lessen property values of <br /> adjoining >to '~gerties, or expose gambling to persons under 18 years of age: <br /> <br /> a, I Areas zoned for agriculture or residential use; <br /> <br /> b, i Locations where the predominant clientele is under the age of 18 years. <br /> <br />Page I of 3 <br /> <br /> <br />
