ORDINANCE 80-8 <br /> CITY OF RA~I~EY <br /> aNO COU Y <br />STATE OF M~R~ESOTA <br /> <br />AMEND~ TO CHAPTER 210.01 ~{ICH IS KNOWN AS THE "STREET ASSESSMENT" ~[APTER OF THE <br />CITY OODE <br /> <br />AN ORDINANCE AMENDING CHAPTER 210.01 OF THE CITY CODE OF R~4SEY, MINNESOTA <br /> <br />The City Council of the City of Ramsey ordains: <br /> <br />SECTION 1. AMENDME~ <br /> <br />A. Section 210.01 FINANCING ARTE~ STREETS WITHOUT LOTS FRONTING <br /> Paragraph 2 shall be amended to read as follows: <br /> <br />2. Upgra(ting of arterial streets not lyJmg Jm the city's thoroughfare <br />system and only benefiting a localized area shall be financed by aid <br />programs and assessment of the benefiting property. Assessments shall <br />be made on a unit area basis with assessments on undeveloped property <br />lying within the area being "deferred" until time of development for <br />a maximum period of five (5) years. Assessments shall be made to the <br />extent to cover costs not available from other sources. <br /> <br />B. Section 210. 014 FINANCING DS~AL RESIDt~fIAL AND INDUSTRIAL STREETS <br /> shall be amended to read as follows: <br /> <br />210. 014 FINANCING LOCAL RESIDENTIAL AND INDUSTRIAL STREETS <br /> <br />1. Replacement of all residential and industrial streets shall be <br />financed by assessing the benefitting property owners on a front foot <br />or unit basis. <br /> <br />2. The improvement of any collector street or major thoroughfare <br />may be fully or ps~tially assessed to the benefitting property owners <br />depending on the particular circumstances of each case as determined <br />by the City Council. <br /> <br />3. For the purpose of establishing a replacegent policy for streets, <br />it is hereby detezYmined that the est~%ed usable life of a street <br />shall be fifteen (15) years from the date of initial construction to <br />the date of the proposed reconstruction. <br /> <br />4. When the condition of a street surface has deteriorated to the <br />point where excessive maintenance cost is incurred by the City, or a <br />majority of abutting residents request an improvement, the City Council <br />may. order a public hearing on proposed improvements for that street. <br />If the City Council, following the hearing, decides that improvements <br />are necessary, it may elect to completely reconstruct the street and <br />assess 100% of the cost of such improvement against benefitting property <br />owners in the matter hereinbefore described. <br /> <br /> <br />
