ORDINANCE NO. 73-6 <br /> <br /> RAMSEY TOWNSHIP <br /> ANOKA COUNTY, MINNESOTA <br /> AN ORDINANCE PROVIDING FOR THE <br /> LICENSING OF DOGS AND <br /> REGULATING THE KEEPINGOF DOGS AND CATS <br /> DOG CONTROL <br /> The Town Board of the Township of Ramsay, <br /> Minnesola~ ordains: <br /> Sectl on t <br /> This ordinanceshallbe known as lhe "Dog <br /> Ordinance." <br /> Section 2 <br /> Asused in the ordinance unless the context otherwise <br /> indicates. <br /> A. "Dog" shall be intended to mean both male and <br /> female. <br /> B. "Owner" shall be intended to mean any person or <br /> persons, firm association or corporation owning, <br /> keeping or harboring a dog. <br /> C. "Al Large" shall be intended to mean Off the <br /> premises of the owner and not under the custody and <br /> control of tile owner or other person either by leash, <br /> cord, chain or olherwlse. <br /> D. "Release Permit" shall be intended to mean a <br /> lemporary release for a period of not more than 72 <br /> hours with purchase fees to be applied to regular <br /> license purchase, provided this is done within the 72 <br /> I~ours. A release permit may be obtained at the <br /> Township's discrelion upon payment of a fee in <br /> accordance 1o that regular license requirement and <br /> payment of release fee ($10.00) and any maintenance <br /> cosls applied. <br />Section 3 RUNNING AT LARGE PROHIBITED <br /> II shall be unlawful for any person who Owns, <br />11arbors or keeps a dog or the parenls or guardians of <br />any suci~ person under 21 years of age, to allow such <br />dog lo run at large. <br />Sectio~ 4 <br /> Dogs on a leash accompanied by a responsible <br />person or accompanied by and under the conlrol and <br />direction of a responsible person so as to be effectively <br />restrained by command as by leash shall be permitted <br />in slreots or On public land unless the Township has <br />posled an area wilh signs reading "Dogs Prohibited." <br />Section 5 LICENSE REQUIRED <br /> Ali dogs, kepi, harbored or maintained by their <br />owners in the Township of Ramsay shall be licensed <br />and registered if over 6 months of age. Dog licenses <br />shall he issued hy the Township Clerk upon payment of <br />a license tee et $3,00 for each mal~or spayed female, <br />and $5.00 for each unspayed female. License fees shall <br />n01 be proraled. The owner shall state at the time <br />application is made for such license and upon forms <br />provided for such purpose his name and address, and <br />lhe name, hreed, color and sex et each dog owned or <br />kept by him. Every applicalion for a license shall be <br />accompanied I)y a certificate from a licensed <br />veterinarian, showing thal the dog to be licensed has <br />been vaccinated with a live modified vaccine against <br />rabies and lhal existing vaccination shall not expire <br />wilhin twelve (12) monlhs of thedate for which license <br /> <br />musl exist for Ihe endurance et lhe license period. The <br />license shall expire two (2) years from date of <br /> <br /> Every application for a license for a spayed female <br />licensed velerinarian indicaling thai the dog has been <br /> <br />license shall be valid only tot lha! period which the <br />veterinarian's cerJiticate indicales lhe vaccine is <br />etioctive. A license shall not be required tot dogs less <br />than six (6) months of age. <br />Section 6 <br /> Upon payment of the license fee, the clerk shall issue <br />to the owner a license certificate and metallic tag for <br />each dog licensed. The shape of the tag shad be <br />changed hiannually and shall have stamped thereon <br />the year from which it was issued and the number <br />corresponding with the number on the certificate. <br />Every owner shall be required to provide each dog with <br />a collar to which the license tag must be affixed, and <br />shall see that ~he collar and tag are constantly worn. In <br />casea dog tag is lost or destroyed, a duplicate will be <br />issued hy tho clerk upon presentalion of a receipt <br />showing the paymenl of the license tee for the currenl <br />year, and payment et one dollar (SI.00) fee for each <br />duplicate. Dog tags shall riel he transferable from one <br />dog to another and no refunds shall be made on any dog. <br />license fee or tag because et death of a dog or the <br />owner's leaving tile Township before the expiration of <br />lhe license period. <br /> The provisions of this section shall not be intended to <br /> <br />temporarily wilhin file Township nor to dogs brought <br /> <br /> into the Township for the purpose of participating in <br /> any dog show nor shall this provision apply to "seeing- <br /> eye" dogs properly trained to assist blind persons for <br /> the purpose of aiding them in going from place fo <br /> place. <br /> Section 7 <br /> The Town Clerk shall pay over monthly to the Town <br /> Treasurer all license and metallic tag fees received by <br /> him. These funds shall first be used to defray any costs, <br /> incidental to the enforcement of this ordinance; <br /> including, but not restricted to, the costs of licenses, <br /> metallic tags and impounding and maintenance of the <br /> dugs or animals of a dog kind. <br /> Section 8 IMPOUNDING AND POUNDMASTER <br /> The proper officer appointed to enforce this <br /> ordinance shall impound any dog found unlicensed or <br /> running at large and shall give notice of the <br /> impounding to the owner of such dog if known. In case <br /> lheowner is unknown, such officer shall post notice at <br /> the Town Hall that if lhe dog is not claimed within <br /> seven (7) days of the posting of the noflce, if will be <br /> disposed of. <br /> All dogs or animals of a dog kind conveyed to the dog <br /> pound shall be kept, with kind treatment and sufficient <br /> food and water for their comfort, at least seven (7) <br /> days, unless sooner reclaimed by their owners or <br /> keepers, as herein provided. In case the owner of <br /> keeper shall desire to reda im the said dog or animal of <br /> a dog kind from the dog pound, the following shall be <br /> required, unless otherwise provided for in this <br /> ordina nee: <br /> I. Payment of a Five ($5.00) Dollar release fee, and <br /> 2. Maintenance costs of Three ($3.00) Dollars per <br /> dayor any part of day while dog or animal of a dog kind <br /> is in said pound, and <br /> 3. If dog Or animal of a dog kind is unlicensed, <br /> payment of a regular license fee and valid certificate <br /> et vaccination for rabies is required. <br /> Section 9 <br /> At the expiration of seven (7) da ys from the ti me any <br /> dog or animal of a dog kind is impounded, if the same <br /> has not been reclaimed in accordance with the <br /> provisions of this ordinance, the officer, appointed to <br /> enforce th is ordinance, may let any person claim said <br /> dog or animal Of a dog kind by complying with all <br /> provisions of this ordinance, including Section 8, or he <br /> may sell the dog or animal of a dog kind to the <br /> University of Minnesota, or he may cause such dog or <br /> animal Of a dog kind to be killed and shall properly. <br /> dispose of lhe remains thereof. Any monies collected. <br /> under this section shall be payable to the Town Clerk, <br /> who shall monthly pay said monies over to the Town <br /> Treasurer. <br />Section 10 <br /> <br /> Except as olherwise provided in this ordinance, if <br /> shall be unlawful fo kill, destroy or otherwise cause <br /> any injury to any dog or animal of a dog kind. Violation, <br /> oi this section shall constilute a misdemeanor. <br /> Seclion I:1 <br /> No person shall keep or suffer fo be kept on his <br /> premises, or on fha premises Occupied by him nor <br /> permil nor suffer lo run at large in said township, any <br /> dogor animal of a dog kind of a ferocious or vicious <br /> characler, habit or disposition, even though said dog or <br /> animal of a dog kind be properly licensed under this <br /> ordinance. <br /> It in fha reasonable belief of any person or officer, <br /> appointed to enforce this ordinance, such dog Or <br /> animal of a dog kind presents an immediate danger to <br /> the health and safety of any person or the said <br /> lownship, said person or officer may kill said dog or <br /> animal of a dog kind forthwith, Otherwise said person <br /> or officer rnay apprehend said dog or animal of a dog <br /> kindand deliver him to the dog pound for confinement. <br /> If the dog or animal of a dog kind is found to present a <br /> danger Io the health and safety of said township, based <br /> upoo a reasonable belief of the officer, appointed to <br /> enforce lhis ordinance, he may be killed or otherwise <br /> disposed of. In such a case the owner or keeper of said <br /> dog or animal of a dog kind shall be liable for the <br /> mainlenance costs provided in Section 8 hereof and a <br /> charge of Five ($5.00) Dollars to dispose of 1he dog or <br /> animal of a dog kind. If said dog or animal of a dog kind <br /> is found not to be a danger to the health and safety of <br /> said township, he may be released to the owner or <br /> keeper in accordance wilh Section 8 hereof. Said dog or <br /> animal of a dog kind may be released to other persons <br /> in accordance with Section 9 hereof. <br /> Section 12 <br /> Noowner or keeper of a femaIe dog or female animal <br /> of adog kind shall perm it or suffer the same to run at <br /> large in said lownship while thesame is in heat, even <br /> though properly licensed under this ordinance. Any <br /> officer, appointed to enforce this ordinance, or any <br /> olher person may deliver said tamale dog OF female <br /> animal of a dog kind fo the dog pound for confinement. <br /> It shall be unlawful for any person to kill any female <br /> <br /> dog or female animal of a dog kind running at large in <br /> violation of this section. However, such female dog or <br /> female animal of a dog kind may be apprehended by <br /> any person and delivered to the proper officer for <br /> confinement in the dog pound. If properly licensed, <br /> saiddogoranimalofa dog kind may be released to the <br /> owner of keeper upon the payment to the Town Clerk of <br /> Five ($5.00) Dollars, and in accordance with Section 8 <br /> hereof, or said female dog or female animal of a dog <br /> kind may be released to any person in accordance with <br /> Section 9 hereof. <br /> Section 13 <br /> No person shall keep or suffer to be kept on his <br /> premises, or on premises OCCUpied by him nor permit <br /> nor suffer to run at.large in said township, any dog Or <br /> animal of a dog kind which is diseased, so as fo be a <br /> danger to the health and safety of said township, even <br /> though said dog or animal of a dog kind be properly <br /> licensed under this ordinance. <br /> Ar.y dog or animal of a dog kind reasonably <br /> suspected of such disease may be apprehended and <br /> confined in the dog pound by any person or officer, <br /> appointed 1o enforce this ordinance. The officer, <br /> appointed to enforce lhis ordinance, shall have a <br /> qualified Yeferinarian examine said dog or animal of a <br /> dog kind. If found lo be diseased in such a manner fo be <br /> a danger fo the health and safety of sa~d township, fha <br /> officer, appointed to enforce this ordinance shall cause <br /> such dog or animal of a dog kind to be killed and shall <br /> properly dispose of the remains. The owner or keeper <br /> of said dog or animal of a dog kind killed under this <br /> section shall be liable for a Five ($5.00) Dollar fine to <br /> cover the cost of disposing of the dog or animal of a dog <br /> kind and lhree ($3.00) Dollars a day maintenance <br /> charge and the costs of any veterinarian examinations. <br /> Ifsaid dog or animal of a dog kind upon examination <br />is not found to be diseased within the meaning of this <br />section then said dog or animal of a dog kind shall be <br />released to th e owner or_keeper free of any charge. <br /> <br /> Section 14 <br /> Whenever any dog or animal of a dog kind within the <br />township shall have bitten any person or persons, the <br />officer, appointed to enforce this ordinance, shall <br />quarantine said dog or animal of a dog kind in the dog <br />pound tot a period of fourteen (14) days from the date <br />lhe person or persons were bitten. During this period a <br />qualified veterinarian shall make as many <br />examinations of the dog or animal of a dog kind as he <br />deems necessary to determine if said dog or animal of <br />a dog kind is sick or diseased so as to be a danger fo fha <br />health and safety of said township. If said dog or <br />animal of a dog kind is found to be sick or diseased, the <br />proper authorilies,as provided by law, shall take <br />possession of the dog or animal of a dog kind to <br />delermine whelher or not the same is suffering from <br />rabies. <br /> If said dog or animal of a dog kind is found fo have' <br />rabies or is otherwise diseased or sick so as fo be a. <br />danger 1o the health and sa lely of said township, he will <br />be killed and the owner or keeper of the dog or animal <br />of a dog kind shag be liable for a fine of five ($5.00) <br />Dollars to cover the cost of disposing of the dog or <br />animal of a dog kind and maintenance costs of three <br />[S3.00) Dollars per day while the dog or animal of a dog <br />kind is confined in the dog pound and the costs of all <br />veterinarian examinations. If said dog or animal of a <br />dog kind is found not to have rabies or otherwise <br />diseased or sick so as to be a danger to the health and <br />safety of said township, the same may be released to <br />lhe owner or keeper upon payment of all costs of <br />veterinarian examinations and in accordance with <br />Section 9 hereof. <br />Section 15 <br /> The town board is hereby authorized to appoint an <br />officer, title to be decided upon, fo enforce the <br />provisions of this ordinance. In said officer's duty of <br />enforcing the provisions of this ordinance, he may <br />from lime to time, with lhe consent of the town board, <br />designate certain assistants. <br /> The town board shall designate a place for the dog <br />pound and cause its location to be known to the public. <br />Section 16 <br /> All fees and charges under this ordinance shall be <br />payable to the town clerk, who shall pay Over each <br />monlh the lotal hereof to the Town Treasurer. <br />Section 17 <br /> The officer, appointed to enforce this ordinance, <br />shall keep an accurate account ora II dogs or ant reals of <br />a dog kind received al fha pound, and of all dogs or <br />animals of a dog Kind killed or released. <br />Section 18 <br /> No person shall in any manner molest, hinder or <br />interfere with any person authorized by the town board <br />1o capture dogs or animals of a dog kind a nd convey the <br />same to fha dog pound while engaged in such <br />occupation. <br /> <br /> <br />
