ANOKA-CHAMPLIN JOINT FIRE DEPARTMENT <br /> <br />CONTRACT--FOR FIRE PROTECTION AND EMERGENCY SERVICES <br /> <br />1990 <br /> <br /> THIS AGREEMENT, made and entered into by and between the Anoka-Champlin Joint Powers <br />Fire Board, the party of the first part, hereinafter referred to as the "Joint Fire <br />Board" the governing body of a fire department jointly owned and operated by the City of <br />Anoka, a Municipal Corporation, of the County of Anoka and State of Minnesota, and the <br />City of Champlin, a Municipal Corporation, of the County of Hennepin and the State of <br />Minnesota; and the CITY OF RAMSEY Fin the County of Anoka, State of Minnesota, party of <br />the second part. <br /> <br /> WITNESSETH: <br /> That in consideration of the sum of sixty-one thousand four hundred fifty-six and 24/t00% <br />dollars per year, payable in advance by second party to said Joint Fire Board, said Joint <br />Fire Board agrees to furnish fire protection, fire suppression, emergency rescue, <br />extrication and those other services normally and customarily performed by a fire <br />department to the property located in, or emergency incidents within the boundaries of <br />said City of Ramsey for the compensation and on the conditions hereinafter set forth, <br />and the said Joint Fire Board further agrees that when called to property or incidents <br />within the boundaries of the city of Ramse7 its firefighters will make a reasonable <br />effort to respond to fires or perform other requested emergency services, PROVIDED <br />HOWEVER: <br /> <br /> L That the road and weather conditions be such that the emergency response can be <br />made with reasonable safety to personnel and equipment, and the decision of the Anoka- <br />Champlin Fire Chief or senior fire department officer in charge shall be final in such a <br />matter. <br /> <br /> 2. That in the event all fire department equipment and personnel are engaged in <br />another emergency situation at the time a call comes in from said second party, the Anoka- <br />Champlin Fire Department will call for mutual aid and any other help that might be <br />available, because of the emergency or disasterous nature of the situation. However if <br />all means of providing service are exhausted, and in the discretion of Joint Fire Board <br />members and the Fire Chief or senior fire officer in charge, such equipment and members of <br />said fire department are needed in Anoka or Champlin, the Joint Fire Board 'shall be held <br />free and relieved from all liability to make said run or to respond to said call. <br /> <br /> 3. 'In the event the Anoka-Champlin Fire Department has responded to an emergency in <br />the City of Ramsey and another fire department emergency response is required within <br />the Cities of Anoka or Champlin, the Anoka-Champlin Fire Department will not leave the <br /> City of Ramsey emergency situation unattended. The Anoka-Champlin Fire Department will <br />either remain to perform the necessary emergency service or will provide services from <br />another municipality through mutual aid agreements. .. <br /> <br /> 4. If for any reason the Fire Chief or senior fi~e officer shall decide that no <br />equipment or firefighters can be spared, the decision of the Fire Chief or senior fire <br />officer shall be final. <br /> <br /> 5. That said Joint Fire Board shall not be liable in any way to the second party or <br />to any other person, firm or corporation for failure of the Fire Department of said Joint <br />Fire Board to attend a fire or to extinguish a fire or for any damage to or loss of goods, <br />or for any act, omission, or for any other reason. <br /> <br /> 6. That in addition to the above mentioned sum of sixty-one thousand four hundred <br />fifty-six and 24/100's dollars per year, said second party agrees to pay as compensation for <br />services rqndered hereunder, the cost of each run by the Fire Department to said City when <br />called by said second party or when made for the benefit of said second party or when made <br />to a place within the boundaries of said second party, said sum to be paid when billed by <br /> <br /> <br />
