Councilmember Peterson introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #92-01-018 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0305 TO REVOCATE THE <br />CONDITIONAL USE PERMIT FOR AUTO SALES/REPAIR ISSUED TO 14600 <br />NOWTHEN BLVD. N.W. (PIN 25-32-25-23-0006) <br /> <br />o <br /> <br />o <br /> <br />That on December 17, 1985, the City of Ramsey approved issuance of a conditional use <br />permit to Mr. Gerald Root (Permit Holder) for an auto/sales repair operation on the <br />property generally known as 14600 Nowthen Blvd. N.W. and legally described as <br />follows: <br /> <br />That part of the Southwest Quarter of the Northwest Quarter of Section 25, Township 32, <br />Range 25, Anoka County, Minnesota, described as follows: <br /> <br />Commencing at the West Quarter corner of said Section 25, thence 90 degrees 00 minutes <br />east, along the south line of said Northwest Quarter, a distance of 829.6 feet; thence north <br />30 degrees 49 minutes 30 seconds west, a distance of 401.96 feet; thence north 29 degrees <br />55 minutes 10 seconds west a distance of 214.2 feet to the actual point of beginning; thence <br />continuing north 29 degrees 55 minutes 10 seconds west a distance of 288.37 feet, thence <br />north 60 degrees 04 minutes 50 seconds east, a distance of 247.03 feet more or less, to the <br />center line of County State Aid Highway No. 5; thence south 29 degrees 55 minutes 10 <br />seconds east, along the centerline of said Highway No. 5, a distance of 416.97 feet; thence <br />south 87 degrees 34 minutes 50 seconds west, a distance of 278.5 feet, more or less, to the <br />point of beginning. <br /> <br />That the first documented violations of the conditional use Permit terms occurred on June 3, <br />1986. The violation consisted of outside storage of junk car parts and rubbish and activity <br />beyond permitted hours of operation. In August of 1986, those violations expanded to <br />include a second use of the subject property: storage of construction vehicles and <br />equipment. The Permit Holder did not bring the operation into compliance with the terms <br />of the conditional use permit until October 28, 1986. <br /> <br />That on February 24, 1987, following an eight (8) month debate with the City regarding <br />materials that qualify as durable and dustless for surfacing purposes and an incident report <br />of business operations on Sundays, the Permit Holder successfully achieved an amendment <br />to the conditional use permit which specified that traprock would be allowed as surfacing <br />material for the site driveway and off-street parking area and only 'outside' operations were <br />prohibited on Sundays. <br /> <br />That the Permit Holder has failed to respond to City Staff requests to sign the conditional <br />use pern~it. <br /> <br />That on May 29, 1987, the City forwarded written notification to the Permit Holder <br />regarding violations of the terms of the conditional use permit consisting of outside storage <br />of vehicle parts, inventory, equipment and rubbish. <br /> <br /> <br />
