The Council took clos-
ing comments from those opposed to and those in
favor of the request. Following that, the City Coun-
cil received a report from City Staff which in sum-
mary stated that the City has sufficient information
to make reasonable conclusions about impact with
the possible exception of four criteria:

a) Whether or not the use will be unduly dangerous
or otherwise detrimental to persons residing or
working in the vicinity of the use or to the public
welfare;

b) Whether or not this use will substantially adverse-
ly impair the use, enjoyment or market value of
any surroudning property;

c) Whether the proposed use will be hazardous or
disturbing to existing or future neighboring uses;

d) Whether the proposed use will involve uses, ac-
tivities, processes, materials and equipment and
conditions of operation that will be detrimental to
any persons, property or the general welfare by
reason of excessive production of traffic, noise,
smoke, fumes, glare or odors.

The City Council then reviewed, amended and
adopted the findings of fact. The conditional use per-
mit process requires the City Council to base their
decision on factual findings gathered and received
during the processing of the permit application. The
findings of fact serve as the basis for whatever ac-
tion City Council takes to grant or deny a request
for a conditional use permit.

The four council members present then voted
unanimously to deny Atlas' request for a conditional
use permit based on the findings of fact.

Ramsey Resident
Ramsey Municipal Center
15153 Nowthen Blvd. NW
Ramsey, MN 55303

* * * COMING SOON * * *
RAMSEY FALL FEST
SEPTEMBER 24, 1988
4:00 P.M. This is located at a point just about 150 feet
north of 149th Avenue and will provide a crossing
area for pedestrians and bicyclists heading for the
Tom Thumb store on the corner. If all persons, adult
and child, will use this crosswalk and use it proper-
ly, Ramsey Blvd. will be a safer place for
pedestrians, at least in that particular area.

With that last sentence in mind, please read on for
some explanation, clarification and heartfelt advice.
Minnesota Statute 169.21, Pedestrians, states in
part:

"Subd. 2 - Rights in absence of signals. Where
traffic-control signals are not in place or in opera-
tion, the driver of a vehicle shall yield the right-
of-way, slowing down or stopping if need be, to
so yield to a pedestrian crossing the roadway
within a crosswalk but no pedestrian shall sud-
denly leave a curb or other place of safety and
walk or run into the path of a vehicle which is so
close that it is impossible for the driver to yield"
and,

"When any vehicle is stopped at a marked
crosswalk or at any unmarked crosswalk at an in-
tersection to permit a pedestrian to cross the road-
way, the driver of any other vehicle approaching
from the rear shall not overtake and pass the stop-
ped vehicle."

"Subd. 3 - Every pedestrian crossing a roadway
at any point other than within a marked crosswalk
or within an unmarked crosswalk at an intersec-
tion shall yield the right-of-way to all vehicles upon
the roadway." and "Notwithstanding the other
provisions of this section, every driver of a vehi-
cle shall: (a) exercise due care to avoid colliding
with any bicycle or pedestrian upon any roadway
and, (b) give an audible signal when necessary
and exercise proper precaution upon observing
any child or obviously confused or incapacitated
person upon a roadway."

Thus speaketh the Law! And it is a good law, design-
ed to protect pedestrians, bicyclists and motorists.
But, PLEASE, all you pedestrians, bicyclists and par-
ticularly the parents of the aforementioned, realize
that this law like any law is a concept, a thought, a
philosophy. The actual, tangible barrier to an oncom-
ing vehicle on Ramsey Blvd. will be a few stripes of
paint perhaps 1/128th of an inch thick. This may slow
down a southbound red ant with six torn knee car-
tilages but even then, not greatly! The crosswalk
must be used properly.

There will be advisory signs posted north and south
of the crosswalk at a distance which will make
motorists aware ot the presence of a crosswalk
ahead. This will then put them on the alert for per-
sons crossing or about to do so and hopefully they
will slow down, preparing to stop if necessary. Talk
to your kids (or yourselves if you do much hiking or
biking) and emphasize to them that they still must
look both ways before crossing a highway, even at
the crosswalk and they can't step out in front of cars
expecting them to stop. Encourage them, insist
even, that they only cross Ramsey Blvd., enroute to
and from the store, at the crosswalk. If a car stops
for them, tell them to be sure the car behind that car
isn't a "bull buffalo" type who just has to whip
around the stopped car so that he/she/it can tram-
ple the rest of the more orderly folks.

In summary, this crosswalk is just an aid, a guide,
to assist in pedestrian safety. It is not a barrier nor
an overpass and it must be recognized for it's limita-
tions.
