City Administrator Schroeder added that the City had said it would spend $70,000 on site <br />improvements - it did - that's clear. Mr. Noard has contended that he was led to believe the City <br />would complete site improvements which would include more than what the $70,000 would cover. <br />You have no responsibility to do anything more. On the off-chance we are wrong, Mr. Noard <br />would get his money back anyway. We feel we have no responsibility to negotiate further. If you <br />want to "put this to bed", maybe we could split the difference. <br /> <br />Councilmember Beyer stated that back in 1987 and 1988, staff and City Council were notorious <br />for saying one thing and doing another. Mr. Noard may have been led to believe something else. <br /> <br />Councilmember Peterson responded that he came on board in 1988 - 1989 and dealt with the clean- <br />up of this. Part of the confusion with Mr. Noard was this money cannot be used for further <br />improvements. He felt that the documents are very clear and he also felt that 50% is more than <br />fair. He would get no more increments. <br /> <br />Mayor Hardin asked about the future City services and what is paid quarterly. <br /> <br />Councilmember Beyer commented that there was a delay and asked if the bill had gone out yet. <br />People were not expecting it to come out on their utility bills. <br /> <br />Ms. Hart answered $500 to $700 per quarter. <br /> <br />Councilmember Zimmerman observed that if we made a deal with Mr. Noard, other businesses <br />would come in looking for the same deal. <br /> <br />Ms. Hart agreed and added there are 12 businesses. <br /> <br />Councilmember Beyer explained that she was just saying that Mr. Noard may have been told <br />something else. <br /> <br />Ms. Hart commented on the letter as documentation. Mr. Noard has been very pleasant and very <br />cordial and she understood his frustration. <br /> <br />Mayor Hardin stated that when Mr. Noard did his expansion, we agreed to pay his TIF. Do we <br />offer something less than that and pay him now or let it ride as it is? He felt it would be better to <br />make an offer - 50% of the $19,000. <br /> <br />Motion by Mayor Hardin and seconded by Councilmember Beyer to counter the offer. Offer a <br />50% discount with the settlement not in cash but as a credit against future City services. Also, that <br />staff should send a letter of apology to Mr. Noard. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beyer, Beahen, Peterson and <br />Zimmerman. Voting No: None. <br /> <br />Case g7: 1997 - 2002 Capital Improvement Program <br /> <br />Parks/Utilities Supervisor Boos stated that the adopted budget calendar shows receipt of the <br />requested 1997 - 2002 Parks CIP by the Finance Committee on August 27, 1996. Earlier this <br />month, the Park and Recreation Commission approved the Five-Year CIP. He pointed out that the <br />emphasis of the Landfill Trust Fund's interest earnings is community parks. Park dedication <br />dollars, when available, will be directed to neighborhood improvements, including trail <br />connections to community parks.
