3) Updste on Potential Projects South of City Hall
The Public Works Committee recommended that the City Council schedule a public hearing for
the proposed improvements, send out a copy of the updated feasibility studies for the three
projects to the respective residents, and initiate negotiations with the appropriate homeowners to
acquire the easements necessary to complete the projects.

Councilmember Zimmerman stated that some of the landowners in Pondvale Estates have been
opposed to the improvements in the past, but if they come forward in favor of the project he
could vote for it.

Dan Murphy, 150th Lane, Pondvale Estates, Ramsey, stated that he has talked to his neighbors
regarding the project and he believes that there is a majority of the property owners in favor of
the project. If the project is approved, he will immediately sell his two additional lots and so will
his neighbor.

Councilmember Elvig stated that he voted in favor of holding a public hearing, but he was not in
favor of stuffing sewer and water into an area where they don't want it. That being said, if the
residents come forward and want the improvement, he would like to be able to provide it to
them.

Mayor Gamec stated that the way the City Charter is written is that any property owner opposed
to the project would not be required to hook-up to City services or pay for the services until the
time they do hook-up to City services.

Principal City Engineer Olson explained that this would be a pilot project and they would not
authorize another project until the City hits a break even point.

Councilmember Kurak inquired if they were looking at all three projects together or would they
be separate.

Principal City Engineer Olson replied that each project has a separate feasibility study and can be
acted on separately.

Councilmember Elvig stated that he wants to make sure that the residents are provided a copy of
the study prior to the public hearing.

Principal City Engineer Olson noted that staff would be sending out a copy of the feasibility
study with the public hearing notice.

Mr. Murphy stated that last time the issue was addressed, the people were afraid that later on the
Council would change their mind and require them to hook up so there was some talk on adding
language to provide some security to the residents.

Principal City Engineer Olson replied that there has been some discussion on repealing the "Due
on Sale" Clause.

City Council/June 10, 2003
