that she was concerned with discussions regarding the connection of Rabbit Street to Nutria
Street. It is Ms. Thomas's opinion that connecting Rabbit Street to Nutria Street will provide for
a considerable amount of increase in traffic to 167th Lane. Ms. Thomas stated that 167th Lane is
already a dangerous road due to its curvy configuration. Subsequent to the Planning Commission
meeting, Ms. Thomas submitted a letter stating her concerns and objections to connecting Rabbit
Street to Nutria Street. It should be noted that the preliminary plat of Tiger Meadows is not
providing for a connection. During the sketch plan review of Tiger Meadows, the City Council
stated interest in providing for a connection from Rabbit Street to Nutria Street, however staff
was only directed to research possible options. The City Council directed the developer to
provide a temporary cul-de-sac to the southeastern plat boundary line. Also during the public
hearing, Taisal Diedrich, 16919 Tiger Street, inquired whether it would be possible to shift 170th
Avenue north in order to provide more separation from the public street to her northern property
boundary line. Subsequent to the Planning Commission meeting, the developer revised the
preliminary plat and shifted 170th Avenue an additional 10 feet north. Shifting 170th Avenue any
further north will be problematic due to the existing wetland located just north of 170th Avenue
on Lot 1, Block 1. In an attempt to provide for some screening along Ms. Diedrich's northern
property line, the developer provided four, 6-foot tall coniferous trees within the right of way of
170~h Avenue. Staff recommended that the developer provide an additional five coniferous trees.
The preliminary plat indicates that Ms. Diedrich's house is located approximately 175 feet from
the edge of the pavement of 170th Avenue. The Planning Commission recommended that the
City Council approve the preliminary plat contingent upon compliance with City Staff Review
Letter dated May 30, 2003, the developer revising the preliminary plat to provide for appropriate
screening from 170th Avenue to the existing single family residential lot located at 16919 Tiger
Street, and the development receiving a variance to cul-de-sac length restrictions. The
preliminary plat has been revised to address the Planning Commissions recommendations.

City Engineer Jankowski noted that in the City staff review letter under grading and drainage, it
states that the developer must receive the appropriate permits from the Lower Rum River
Management Organization (WMO), which has not yet been done. In reviewing the plan with the
WMO, it became clear that the plan submitted would not be approved because the basement
elevations are below the regional flood elevation. There is an opportunity to change the grading
plan, which would not impact the actual layout of the lots.

Councilmember Zimmerman inquired if the WMO permit requirement could be incorporated
into the approval.

City Engineer Jankowski recommended that preliminary plat approval be made contingent upon
receiving approval from the WMO.

Associate Planner Wald noted that that requirement is included in the City staff review letter.

Councilmember Cook stated that the preliminary plat identifies a cul-de-sac near Nutria Street,
and questioned if it is deemed feasible to make a connection from the new development and the
existing development through the park via a parking lot, if they could have the developer spend
the money on that connection rather than constructing the cul-de-sac.

City Council/June 24, 2003
