recommending that the developer reevaluate where the location of the house pads are being <br />proposed on the preliminary plat. She explained it appears that several of the house pad locations <br />will not provide for the most effective and efficient means for future re-subdivision in the event <br />City services are extended to the subject area. She stated Staff is recommending that the area <br />encompassed by Lots 1 and 2 be subdivided into two lots with a north/south boundary line as <br />opposed to the east/west boundary line shown on the preliminary plat. Providing for a <br />north/south boundary line would allow the property to gain access to 170th Avenue in the event <br />the house was raised or damaged beyond 50% of it value, thereby eliminating an access onto <br />County Road 83. She advised Staff is recommending preliminary plat approval contingent upon <br />compliance with City Staff Review Letter dated May 30, 2003. <br /> <br />Chairperson Nixt opened the public hearing at 7:40 p.m. <br /> <br />Kelly Thomas, 8433 168th Lane, stated she wants to understand how long the variance for the <br />dead-end cul-de-sac would last. <br /> <br />Commissioner Johnson stated it would not be the Commission's action to connect the street, the <br />City Council would have to take that action. <br /> <br />Ms. Thomas stated that safety is an issue in this area. If people are driving over 20 mph someone <br />is going to get killed. <br /> <br />Chairperson Nixt indicated Ms. Thomas has valid points. He asked that staff notify her if the <br />City Council plans to take action on this cul-de-sac. <br /> <br />Commissioner Johnson stated they agree with Ms. Thomas, but it would be best if she spoke <br />with the City Council. <br /> <br />Chairperson Nixt indicated the best bet is to convince the City Council that the cul-de-sac is the <br />best way to go. He stated the problem is there is onty one access, and if there is an accident or <br />problem there is no alternate way in or out. <br /> <br />Taisal Diedrich, 16911 Tiger Street asked if anything was done about the proposed entrance. She <br />stated it is very close to her driveway. <br /> <br />Associate Planner Wald stated the developer looked at shifting the entrance north but there is a <br />delineated wetland close to it, which makes moving it difficult. <br /> <br />Chairperson Nixt asked if the entrances could be screened. <br /> <br />Jim Kline, developer for the property, stated the access is close to the Diedrich' driveway, and he <br />could possibly pull it to the north slightly. He indicated the stake mentioned is the property line, <br />not the right-of-way or the street line.
