will be able to completely implement the conditions of the conditional use permit prior to June <br />26, 2003. Consequently, St. Paul Terminals is requesting another extension of the conditional <br />use permit. As mentioned earlier, a request for extension must be reviewed by the Planning <br />Commission and City Council. Unfortunately, Staff did make an error in scheduling and the <br />request for extension has not been reviewed by the Planning Commission. The request is <br />proposed to be on the July agenda for the Planning Commission.' The current extension expires <br />on June 26; the soonest City Council can take action on the request is July 15. Staff <br />recommended that City Council grant a 21 day administrative extension to the conditional use <br />permit to allow the Planning Commission the opportunity to consider the request and make a <br />recommendation to City Council. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Kurak, to grant a 21 day <br />extension to July 17, 2003 relating to the conditional use permit issued to St. Paul Terminals for <br />a recycling facility. <br /> <br />Motion carried. Voting Yes: Mayor Qamec, and Councilmembers Elvig, Kurak, Cook, Pearson, <br />and Zimmerman, Voting No: None. <br /> <br />Case #14: <br /> <br />Consider Authorization of Utility Easement Compensation with the City of <br />Anoka Utilities <br /> <br />City Administrator Norman stated that the cities of Anoka and Ramsey entered into a right of <br />entry agreement on July 11, 1995, whereby Ramsey granted Anoka access to its parcels for <br />construction of the electrical utility line. The agreement described the specific Ramsey parcels <br />and permitted Anoka to commence construction immediately, but it did not provide for payment <br />of Ramsey's damages. Negotiations have continued for close to eight years. On May 22, 2003, <br />the City Administrator of Ramsey and City Manager of Anoka met in a negotiation session with <br />their respective City Attorney' s. The parties agreed to a compensation settlement in the amount <br />of $65,000. Staff will be recommending the settlement agreement for Council consideration. <br />The City Attorney will be directed to draft the necessary language to complete the settlement <br />agreement. <br /> <br />Councilmember Cook inquired as to which City fund the money will be deposited. He thought <br />initially there were discussions about depositing the money into the Park Fund since the easement <br />was on park land. <br /> <br />Councilmember Kurak replied that with the City's deficit the money should go into the general <br />fund. <br /> <br />City Administrator Norman noted that there has been some discussion regarding the <br />redevelopment of Old Town Hall. <br /> <br />Mayor Gamec stated that he would prefer that the money go into general fund. <br /> <br />City Council/June 10, 2003 <br />Page 17 of 24 <br /> <br />P67 <br /> <br /> <br />
