City. Attorney Goodrich. stated that the City has entered into a T~ agreement with Lundeen Holdings, LLC. As part of the transaction, the City is to convey title to Lot 4, Block 1, Gateway North Industrial Park No. 5 to Lundeen, LLC. In order to complete this transaction, a sale ordinance needs to be introduced and adopted authorizing the sale. Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, to introduce Ordinance #01- which is an ordinance authorizing the sale of Lot 4, Block l, Gateway North Industrial Park No. 5. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Hendriksen, Kurak, and Zimmerman. Voting No: None. Case #$: Consider Introduction of Trespassing Ordinance City Administrator Norman stated that earlier in the summer, the Ramsey Police Department ticketed four juveniles, who were sitting, on the landfill watching fireworks. The Anoka County Attorney's office refused to proceed with the matter because State Statue does not prohibit such activities. Simply walking on a property that has a "no trespassing" sign or a fenced in area does not trigger a trespassing violation. If an individuai is asked to leave and they refuse to leave, or if the individual is asked to leave and they return, they can be cited for trespassing under State Statue. The County Attorney's office suggested that the City adopt a trespassing ordinance similar to the Coon Rapids trespassing ordinance, in order to prosecute for such violations. Staff would encourage the Council consider a trespassing ordinance in the interest of cooperating with the Minnesota Pollution Control Agency in their management of the closed Ramsey-Anoka landfill. Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to direct the City Attorney to draft a Trespassing Ordinance for further action. Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmer'man, Anderson, and Kurak. Voting No: None. Case #6: Set Special Election Date to Consider Charter Amendments Issues City Administrator Norman stated that the City Council considered the establishment of a special election to consider Charter amendment questions during its meeting of July 24, 2001. The special election date was set at October 16, 200l. During a Charter Commission meeting held on August 9, 2001, the Commission formally moved tO recall those Charter amendments forwarded to the City Council and to resubmit the same proposed amendments to the City Council for its August 28, 2001 meeting. This action allows for an extension of the 90-day period, which by State Statue is the required time period in which the City Council must schedule the special election.
