City. Attorney Goodrich. stated that the City has entered into a T~ agreement with Lundeen <br />Holdings, LLC. As part of the transaction, the City is to convey title to Lot 4, Block 1, Gateway <br />North Industrial Park No. 5 to Lundeen, LLC. In order to complete this transaction, a sale <br />ordinance needs to be introduced and adopted authorizing the sale. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Hendriksen, to introduce <br />Ordinance #01- which is an ordinance authorizing the sale of Lot 4, Block l, Gateway <br />North Industrial Park No. 5. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Anderson, Hendriksen, Kurak, <br />and Zimmerman. Voting No: None. <br /> <br />Case #$: Consider Introduction of Trespassing Ordinance <br /> <br />City Administrator Norman stated that earlier in the summer, the Ramsey Police Department <br />ticketed four juveniles, who were sitting, on the landfill watching fireworks. The Anoka County <br />Attorney's office refused to proceed with the matter because State Statue does not prohibit such <br />activities. Simply walking on a property that has a "no trespassing" sign or a fenced in area does <br />not trigger a trespassing violation. If an individuai is asked to leave and they refuse to leave, or <br />if the individual is asked to leave and they return, they can be cited for trespassing under State <br />Statue. The County Attorney's office suggested that the City adopt a trespassing ordinance <br />similar to the Coon Rapids trespassing ordinance, in order to prosecute for such violations. Staff <br />would encourage the Council consider a trespassing ordinance in the interest of cooperating with <br />the Minnesota Pollution Control Agency in their management of the closed Ramsey-Anoka <br />landfill. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Zimmerman, to direct the <br />City Attorney to draft a Trespassing Ordinance for further action. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Zimmer'man, <br />Anderson, and Kurak. Voting No: None. <br /> <br />Case #6: Set Special Election Date to Consider Charter Amendments Issues <br /> <br />City Administrator Norman stated that the City Council considered the establishment of a special <br />election to consider Charter amendment questions during its meeting of July 24, 2001. The <br />special election date was set at October 16, 200l. During a Charter Commission meeting held on <br />August 9, 2001, the Commission formally moved tO recall those Charter amendments forwarded <br />to the City Council and to resubmit the same proposed amendments to the City Council for its <br />August 28, 2001 meeting. This action allows for an extension of the 90-day period, which by <br />State Statue is the required time period in which the City Council must schedule the special <br />election.
