Further discussion: Chairperson Bawden felt that regardless of whether the Commission agrees <br />with the use or not, this request is within the intent and purposes of the CUP process. Zoning <br />Administrator Frolik explained that Staffs interpretation of Section 9.03.04 is that the purpose of <br />the CUP process is to allow uses that are compatible with the neighborhood. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Deemer to add a finding to read <br />"That the Planning Commission received into evidence at the public hearing five letters from <br />neighboring residences, two in favor and three opposed to granting a conditional use permit." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners LaDue, Deemer, Hendriksen, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to recommend that <br />City Council adopt the amended Findings of Fact relating to Mr. Bahn's request for a CUP to store <br />commercial landscaping equipment in a residential district. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Deemer, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Thorud to recommend that City <br />Council deny Mr. Bahn's request for a conditional use permit, based on the negative Findings of <br />Fact, and grant a seven-month grace period to expire 1/1/96 with which to relocate the landscaping <br />operation to an appropriate district. <br /> <br />Further Discussion: The Commission asked the Mr. Bahn whether this grace period was <br />acceptable, and he requested the grace period be extended to 3/31/96 in order to use the complete <br />winter season (his slow time) to relocate. <br /> <br />Amendment by Commissioner LaDue and seconded by Commissioner Thomd to grant Mr. Bahn a <br />ten-month grace period to expire 3/31/96. <br /> <br />Amendment carded. Voting Yes: Chairperson Bawden, Commissioners LaDue, Thorud, Deemer, <br />and Hendriksen. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners LaDue, Thorud, Deemer, and <br />Hendriksen. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Case #2: Request for a Conditional Use Permit to Store Commercial <br /> Equipment in the R-1 Rural Residential District; Case of Don Godden <br /> <br />Chairperson Bawden asked Applicant Don Godden how often the semi tractor and trailer is parked <br />at his residence, and Mr. Godden replied that he is a local driver and therefore it is parked there <br />every night. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Consensus of the Planning Commission was to accept #1 through #11 as presented. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Thorud to amend the Findings <br />of Fact in the negative. <br /> <br />Planning Commission/June 6, 1995 <br /> Page 4 of 14 <br /> <br /> <br />
