Further Discussion: Commissioner Thomd inquired whether them were any places in the city that
provide storage, and Commissioner Deemer responded that it would have to be commercial
property due to the weight of the semi tractor and trailer.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Thorud,
Hendriksen, and LaDue. Voting No: None. Absent: Commissioners Holland and Terry.

Motion by Commissioner Thorud and seconded by Commissioner Deemer to add a finding to read
"That the Planning Commission received into evidence at the public hearing one letter from a
neighboring residence in favor of granting a conditional use permit."

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Thorud, Deemer,
Hendriksen, and LaDue. Voting No: None. Absent: Commissioners Holland and Terry.

Motion by Commissioner Deemer and seconded by Commissioner Thorud to recommend that City
Council adopt the amended Findings of Fact relating to Mr. Godden's request for a conditional use
permit to store commercial equipment in a residential district.

Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Thorud,
Hendriksen, and LaDue. Voting No: None. Absent: Commissioners Holland and Terry.

Mr. Godden advised the Planning Commission that he has been checking into a relocation but has
found nothing. He stated that he has checked virtually every commercial lot in the area.

Chairperson Bawden suggested that the City should work with these people and come up with an
alternative they can look into since there will be more residents with this type of problem.

Motion by Commissioner LaDue and seconded by Commissioner Deemer to recommend that City
Council deny Mr. Godden's request for a conditional use permit, based on the negative Findings
of Fact, and grant a grace period to expire on 1/1/96 in order to make arrangements to store the
equipment in a more appropriate district. If the applicant is unable to find a relocation and has
made a good faith effort, he can return to City Council with his request.

Motion carded. Voting Yes: Chairperson Bawden, Commissioners LaDue, Deemer, Hendriksen,
and Thorud. Voting No: None. Absent: Commissioners Holland and Terry.

Chairperson Bawden recessed the Planning Commission meeting at 8:32 p.m.

Chairperson Bawden called the Planning Commission meeting back to order at 8:41 p.m.

Case #3: Request for a Conditional Use Permit to Grade and Export Soils in
Northfork Lake Addition; Case of North Fork, Inc.

City Engineer Jankowski advised that what is being proposed is not going to substantially change
existing drainage patterns, however, there will be some change during the excavation. Therefore
Staff recommends it be done as soon as possible to get in and out within a 2-3 week period.

Commissioner Deemer inquired about dust control, a concern brought up at the public hearing.

Mr. Jankowski advised that there are certain conditions regarding wind velocity, and that is another
reason Staff requests this be accomplished quickly. He added that the wind factor can also slow
the project down.

The Planning Commission proceeded to review the Findings of Fact.

Planning Commission/June 6, 1995
