Motion by Commissioner Thorud and seconded by Commissioner Deemer to amend #7 to read <br />"That the Applicant has stated that the project should have minimal adverse impact on the adjacent <br />residential parcels as exporting of the earth material can be accomplished" <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Thorud, Deemer, <br />Hendriksen, and LaDue. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />An unidentified resident inquired as to the route to be used for the hauling, and Mr. Jankowski <br />described the proposed route. <br /> <br />The resident advised that Glen Rehbein, Inc. is excavating a second lake at Northfork, mining all <br />day with belly dumps, and is producing a major cloud of dust. He suggested a limit to the <br />weekday hours and allowing no activity on weekends. <br /> <br />Mr. Jankowski stated City Staff would have to research the Rehbein project, and if it is creating a <br />problem with the residents, the City may have to revisit the permit. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to amend the <br />Findings of Fact in the affirmative. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Deemer, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to recommend that <br />City Council adopt the amended Findings of Fact relating to North Fork's request for a conditional <br />use permit to grade and export soils. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Deemer, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />The Planning Commission proceeded to review the terms of the conditional use permit. <br /> <br />Dennis Peck, Director of Development for North Fork, Inc., stated he could not speak as to the <br />specific timing for the project, but advised that it would be done in one consistent move. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Hendriksen to recommend that <br />City Council approve North Fork's request for a conditional use permit to grade and export soils, <br />making the appropriate modifications to the resolution declaring terms of same. <br /> <br />Motion carded. Voting Yes: Chairperson Bawden, Commissioners Deemer, Hendriksen, LaDue, <br />and Thorud. Voting No: None. Absent: Commissioners Holland and Terry. <br /> <br />Case #4: Request for a Conditional Use Permit for Grading Soiis in Northfork <br /> Links Addition; Case of North Fork, Inc, <br /> <br />City Engineer Jankowski stated concerns regarding rear drainage of the lots and driveway drainage <br />and slopes. He also noted concern from residents buying their lots in good faith that these lots <br />were unbuildable. <br /> <br />Dennis Peck, Director of Development for North Fork, Inc., stated that this project is under review <br />by the Northfork Homeowner's Association architectural review committee.
