Further Discussion: Commissioner Deemer suggested amending #10 to include garage sales in <br />order that Ms. Dempsey isn't having garage sales every other weekend to sell her dolls. Ms. <br />Dempsey replied that although she doesn't have garage sales and doesn't intend to, she didn't feel <br />the City had the right to prohibit her from having a garage sale. Ms. Frolik stated she believed that <br />City Code does restrict residents to two sales per year. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Hendriksen, Deemer, <br />Holland, and Terry. Voting No: None. Absent: Commissioners LaDue and Thorud. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adopt the resolution approving the issuance of a home occupation permit at 14794 Krypton <br />Court N.W. and declaring terms of same. <br /> <br />Motion carried. Absent: Commissioners LaDue and Thorud. <br /> <br />Case #5: Request for a Dwelling Moving Permit; Case of Reggie's Mobile <br /> Home Transport and Fred Mertens <br /> <br />Zoning Administrator Frolik stated that Fred and Jeanette Mertens have purchased Lot 8, Block 1, <br />Pineview Estates 2nd Addition and have submitted a request for a Dwelling Moving Permit to place <br />a modular home on the lot. The structure and its placement are in compliance with the State <br />Building Code and the City's zoning ordinances. Ms. Frolik explained that the property is zoned <br />Planned Unit Development (Residential/Commercial) with covenants (which the City is not <br />responsible for enforcing) requiring that Lots 7 and 8 have a common driveway and Lots 9 and 10 <br />have a common driveway. The common lot line between Lots 9 and 10 is wetland and no <br />driveway is feasible at that location, therefore, Lot 10 must have its own driveway. Mr. Mertens <br />desires to develop his home with a tuck under garage which is only possible if the driveway comes <br />into the property from the east, and so he is proposing to the Homeowner's Association that his lot <br />have a common driveway on the east property line with Lot 9, and he has signed a commitment to <br />also provide a 15 foot easement on his west property line in the event that Lot 7 develops with a <br />commercial activity in the rear yard and needs the additional driveway width for ease in <br />maneuverability. The Homeowner's Association has accepted his proposal. <br /> <br />Commissioner Terry cited City Code, Section 8.35, Subd. 7, item 2, "The dwelling to be moved, <br />after being so moved, must have an assessed valuation representative of the median of the <br />neighborhood in which it is to be located, as determined by the City Assessor." Commissioner <br />Terry noted that there have been two homes built with values ranging from $125,000 to $150,000, <br />and he felt that there is a big discrepancy between the value of this home and the others. <br /> <br />Marty Pemper, Reggie's Mobile Home Transport, Inc., stated that the appraisal done on the <br />property is estimated to be at $130,000. He stated that with the garage and all the lot <br />improvements, it should be well within the median of the neighborhood. <br /> <br />Commissioner Holland inquired of the assessed value of the home. <br /> <br />Mr. Pemper stated that it's value is $60,000 to $70,000 without the foundation. <br /> <br />Commissioner Deemer noted that the home is rather large. <br /> <br />Mr. Pemper stated that it is 1,568 square feet---larger than the home across the street. <br /> <br />Commissioner Deemer inquired whether the basement was visible from the front of the house. <br /> <br />Planning Commission/July 5, 1995 <br /> Page 10 of 13 <br /> <br /> <br />
