Mr. Jankowsld agrccd that this was quitc an impact. Thc drivcway certainly would be restored. A <br />mature tree cannot be replaced, however, a reasonable amount of landscaping could be done. <br /> <br />Commissioner Thorud inquired whether the City ever considers cash restitution for trees. <br /> <br />Mr. Kempf replied that he is not interested in the money, "you cannot replace trees." <br /> <br />Mr. Jankowski responded that the City tries to negotiate a reasonable settlement or they will resort <br />to other methods. <br /> <br />Commissioner Deemer inquired whether it was possible to bore, and Mr. and Mrs. Kempf <br />responded that the terrain would not accommodate boring. <br /> <br />Commissioner Thomd inquired whether the Kempf's would be required to hook up to sewer and <br />water, and Mr. Jankowski replied that City policy requires them to hook up within two years. <br /> <br />Commissioner Deemer inquired whether the other neighbors were notified of the two-year hook-up <br />rule. <br /> <br />Mr. Jankowski stated he was unaware whether they were specifically notified on this issue, <br />however, they were notified in the past at an informational meeting regarding the paving project. <br />Discussions occurred at that time concerning the anticipation of the sewer and water in the area and <br />the hook-up policy was also reviewed. <br /> <br />Commissioner Henddksen inquired about the alternative routes for drainage should it be <br />determined that there isn't sufficient ponding in the development, and Mr. Jankowski outlined the <br />alternative routes. <br /> <br />Commissioner Thomd inquired about the current drainage route, and Mr. Jankowski described <br />such. <br /> <br />Commissioner Thomd questioned whether the drainage could be contained on the property. <br /> <br />Commissioner Deemer replied "only if you direct it to the commercial lot." <br /> <br />Commissioner Thorud stated it would be his recommendation to do just that. <br /> <br />Mr. Jankowski explained that the ponding would need to be large enough to handle a 100-year <br />melt event, which would be quite a large pond. <br /> <br />Commissioner Deemer noted that the outlot proposed to be zoned commercial has a residential <br />structure on it, and he pointed out the City's policy regarding multiple use. <br /> <br />Ms. Frolik advised that the applicant is aware of this and is planning to move the structure out. <br /> <br />Commissioner Deemer also commented that the shrubbery on the comer of that lot should be taken <br />out because the sight line for traffic on T.H. #47 at that intersection is poor. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Holland to recommend that City <br />Council grant preliminary plat approval to Brandseth contingent upon compliance with the <br />November 29, 1995 City Staff review letter. <br /> <br />Planning Commission/December 5, 1995 <br /> Page 6 of 13 <br /> <br /> <br />
