He thanked Council for allowing his input and expressed concem about <br />future utilization of ditch laws. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to close the <br />public hearing. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen <br />and Zimmerman. Voting No: None. <br /> <br />The public heating adjourned at 8:17 p.m. <br /> <br />Council Business <br /> <br />Mayor Hardin called the regular portion of the City Council meeting back to order at 8:17 <br />p.m. <br /> <br />Terry Hendriksen, 15631 Ramsey Boulevard N.W., Ramsey, stated he has a lot to do with <br />why the other residents are here. He reported that he has never been in favor of assessing <br />this project. The original project was not to be assessed; it was only at an earlier meeting <br />that it was suggested it be handled under Chapter 444. He noted that Clayton Berg was the <br />building inspector at the time he constructed his buildings. The largest building was <br />inspected by Mr. Berg and to the best of his (Hendriksen's) knowledge, the building is in <br />conformance with City Code. He continued that when he built the loafing shed, he was red <br />tagged because he needed a conditional use permit, which he got. He reported that he has <br />followed every rule of the City. <br /> <br />Councilmember Peterson stated that a comment was made about assessing the project using <br />property value and inquired of Attorney Goodrich if it could be done on land area. <br /> <br />City Attorney Goodrich stated that we do not have the ability to do that. <br /> <br />Mayor Hardin asked for clarification on subdistricts. <br /> <br />Mr. Goodrich stated if it were assessed to subdistricts, we would have to amend the <br />ordinance to create subdistricts as there are none right now. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to adopt <br />Resolution g95~03-049 ordering the project and the preparation of plans and specifications <br />for Improvement Project g95-12. <br /> <br />Motion carded. Voting Yes: Councilmembers Peterson, Zimmerman and Beyer. Voting <br />No: Mayor Hardin and Councilmember Beahen. <br /> <br />Councilmember Beyer expressed a need to look at other areas of the City with regard to <br />drainage problems. <br /> <br />Mayor Hardin agreed that the City does have drainage problems. <br /> <br />Councilmember Zimmerman stated we have maintained public roads, bridges, etc., but we <br />have not maintained our drainage ditches. The project ditch was built in 1890 and basically <br />no maintenance has been done on it.
