Mr. Jankowski stated they said they do not need any additional right-of-way to <br />accommodate their project in the next year but future projects could require more fight-of- <br />way. <br /> <br />Mr. Johnson added that Mr. Jankowski contacted the State of Minnesota regarding this. <br /> <br />Mr. Jankowski pointed out that in the review letter, they did not indicate a request for more <br />fight-of-way, but added that they had not returned his phone call as yet. <br /> <br />Mayor Hardin suggested tabling this issue until Mr. Jankowski heard back from the State. <br /> <br />Mr. Johnson commented that he thought they were coming to the meeting tonight with <br />everything worked out. <br /> <br />Mr. Jankowski stated that the issue is they do not know what kind of development they <br />will have on Lots 1 and 2 and we do not know what the configuration of the roadway will <br />be. He suggested platting Lots 1 and 2 as outlots. We could see what type of development <br />would take place at the time of platting; however, the developers would have the cost of <br />going through the second platting process. <br /> <br />Mr. Johnson noted the additional cost of the platting process and also the additional time. <br />He stated he did not know what other information would be obtained. <br /> <br />City Administrator Schroeder asked if the goal was to get an additional 120 feet of fight-of- <br />way. <br /> <br />Councilmember Zimmerman stated that if we go to 45 feet and 75 feet, they would be in <br />line with what the County requires. He stated he reduced his original request and asked <br />why Mr. Johnson feels he should be granted privileges other developers do not get. <br /> <br />Mr. Johnson replied that he was not aware that he was deviating from anything. <br /> <br />Councilmember Zimmerman reiterated that this is a State road, the County has nothing to <br />do with it. He added that Mr. Johnson will also need to get approval from the Army Corps <br />of Engineers to discharge water into the low area and that should be available in a couple of <br />weeks. He advised that Council prefers to have the letters from all the agencies available to <br />them prior to granting approval. <br /> <br />Mr. Schroeder perceived that the developer is concerned about expediting the process and if <br />Council wants to approve this with 12 feet, that's okay, and if the developer is not satisfied <br />with that, he can appeal. It appears it would make Council more comfortable with the <br />fight-of-way. <br /> <br />Mr. Johnson responded that they can't sell that 12 feet if it's fight-of-way but stated he <br />would agree to that here tonight subject to getting concurrence from his partner if City <br />Council would vote affirmatively on the final plat. <br /> <br />Councilmember Zimmerman stated 45 feet instead of 33 feet to which Councilmember <br />Peterson agreed. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to adopt <br />Resolution #95-06-131 granting final plat approval to River 47 Plaza, contingent upon <br />compliance with City Staff Review Letter dated June 21, 1995, and resolution of access <br />onto Highway #47 with MnDOT and Anoka County and that the agreement be amended to <br />read that an additional 12 feet of right-of-way be dedicated along the east property line of <br />Lots 1 and 2. <br /> <br />City Council/June 27, 1995 <br /> Page 10 of 19 <br /> <br /> <br />
