C.S.A.H. 4/116, the developers are proposing to construct a private service road through <br />the property to access the three lots. The service road is proposed to have one access onto <br />C.S.A.H. gl 16 and one access onto T.H. #47 that aligns with the entrance to River's Bend <br />Plaza on the east side of #47. MnDOT has recommended that the access onto #47 be a <br />right-in/right-out only access. City Staff has recommended, and the developers have <br />agreed, to provide an additional 27 feet of right-of-way on the east boundary of Lot 3 to <br />facilitate any future improvements to the 47/116 intersection. The developers will also be <br />dedicating a 12-foot easement along the eastern boundary of Lots 1 and 2 for trail, drainage <br />and utility purposes. Park dedication shall consist of a cash payment and staff and the <br />Planning Commission recommend final plat approval. Ms. Frolik reported that because of <br />differing opinions of MnDOT and Anoka County, if Council approves this request, it <br />should be contingent upon resolution with MnDOT and Anoka County of access onto <br />Highway #47. <br /> <br />Councilmember Zimmerman stated that we have a 75-foot dedication on the east side of <br />Highway #47 and in Flintwood Hills as well as in River's Bend Plaza. Now, this is <br />talking about one of the major intersections and we are allowing only 30 feet. He inquired <br />why all developers aren't treated alike. <br /> <br />City Engineer Jankowski stated that staff had requested an additional right-of-way on the <br />west line so we would extend the right-of-way an additional 60 feet. We consulted with <br />the County Highway Department who said they would only need temporary easement for <br />the current project planned for 1996. <br /> <br />Councilmember Zimmerman stated that's a State highway, the County wouldn't comment <br />on that. <br /> <br />Mr. Jankowski responded that the County is designing that project. <br /> <br />Councilmember Zimmerman felt that would suffice short-term. <br /> <br />Mr. Jankowski stated that is a good point and that he had brought that up with the <br />developers. They were reluctant to dedicate any more right-of-way than necessary. As a <br />compromise, they will dedicate an additional 27 feet to bring the total right-of-way from the <br />center line to 60 feet for the southern-most lot and dedicate a 12-foot trail easement <br />immediately to the west of the right-of-way on the northern two lots. The City would <br />locate the trail on that easement. <br /> <br />Councilmember Zimmerman stated he cannot support this - the minimum he would accept <br />is 45 feet. We need to treat all our developers alike. <br /> <br />Mr. Jankowski stated if we were to locate a trail on that, that's what we would end up <br />with. <br /> <br />Councilmember Peterson agreed that the City should get at least 45 feet. <br /> <br />Wayne Johnson stated that they have been working on this project for six to eight months <br />and was told he did not have to deed any additional right-of-way over. Our position is that <br />the compromise is to deed additional right-of-way on the corner lot and 12 feet trail <br />easement west of the right-of-way on the two lots. On the north lot, we have a problem <br />because the wetland which was delineated in quite a generous manner has cut into that site. <br />We will have a difficult time making it a developable lot. We have talked to the County - <br />they have told us repeatedly they do not need any additional right-of-way along Highway <br />#47 because of the extra land they have on the east side. <br /> <br />City Council/June 27, 1995 <br /> Page 9 of 19 <br /> <br /> <br />
