substance of his conversation with Mr. Hardin is protected by Attorney/Client privilege. <br />Mr. Hendriksen felt an in depth investigation should go forward. <br /> <br />Councilmember Zimmerman inquired what MS 471.87, subdivision 2, refers to in Mr. <br />Hendriksen's request for investigation. <br /> <br />Mr. Hendriksen replied that this section deals with the requirements of disclosing financial <br />interest (i.e., when a Mayor or Councilmember works for an official depositor for the City, <br />that should be disclosed). Such disclosure was not made. Mr. Hendriksen continued that <br />he is personally very suspicious that when Mr. Hardin took this position on the Council, he <br />was unemployed. Then after he had this City position, he took a position as vice president <br />of the Northeast State Bank and this was never disclosed. Mr. Hendriksen felt that this is a <br />violation of MS 471.87. Mr. Hendriksen reported that he took minutes and resolutions to a <br />lawyer for an independent opinion. The lawyer concurred that this violation had occurred <br />based on what is found in the minutes. He asked that an investigation be done under <br />Chapter 2.8 of the City Charter. <br /> <br />Councilmember Beyer felt that there was just cause for an investigation. <br /> <br />Motion by Councilmember Beyer and seconded by Councilmember Zimmerman to add this <br />issue as a case for discussion on tonight's agenda for Council action. <br /> <br />Motion failed: Voting Yes: Councilmembers Beyer and Zimmerman. Voting No: <br />Councilmembers Beahen and Peterson. Abstain: Mayor Hardin. <br /> <br />APPROVE AGENDA <br /> <br />Zoning Administrator Frolik requested removing Case #6: Request for Site Plan Approval <br />of a Multi-Tenant Retail Facility; Case of North Lake Properties, Inc.; the applicant has <br />withdrawn their request. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to <br />approve the agenda with the following amendments: Consent Items #13, 14 and 15 be <br />moved to the regular agenda as Case # 18, 19 and 20 and Case #6 on the regular agenda be <br />removed at the applicant's request. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer <br />and Peterson.
