Councilmember Peterson inquired if any of the communities provided language for <br />differing from the start time. <br /> <br />Ms. Frolik replied that some communities have a temperature threshold. <br /> <br />Councilmember Beyer suggested that if we are expecting it to be a 90° or above, it's not fair <br />to make the construction worker wait until 7:00 a.m. to start work. <br /> <br />Motion by Councilmember Peterson and seconded by Mayor Hardin to introduce the <br />ordinance amending City Code regulations for construction work hours to 7:00 a.m. to <br />10:00 p.m. with verbiage allowing the contractor to request a variance to that start time due <br />to hot weather, by contacting City staff. <br /> <br />Further discussion: Councilmcmber Bcycr felt that is an undue burden put on thc <br />construction workers. Mr. Schroeder suggested allowing them to start early and if we do <br />not get any complaints, fine, if so, we could let them know. We have given some <br />flexibility. Mayor Hardin stated he likes the ability of the contractor to call and request and <br />get immediate approval without having to wait to get an actual permit. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beahen and <br />Zimmerman. Voting No: Councilmember Beyer. <br /> <br />Case #10: Sale of Public Works Site <br /> <br />City Administrator Schroeder reported that the negotiations with the Isanti State Bank are <br />not yet complete; however, he is asking for authorization to sell the property by ordinance. <br />The sale cannot be effected until 30 days after publication of the authorizing ordinance. <br />Therefore, we are asking for adoption of the ordinance thinking that to not do so "could" <br />delay a sale. With regard to the environmental audit, he stated there were two tanks on the <br />property that were removed in 1990 and the Pollution Control Agency is not aware of that; <br />therefore, the proper steps were not taken. It would cost about $1,500 which includes <br />some additional site research. He stated he needs to have approval to go ahead and do <br />more environmental research which includes a short-form boring and chemical analysis. If <br />nothing is found, fine, if something is found then that's a whole other matter. If it's a <br />minor issue, it's a matter of a remediation plan that could be very simple but if it's <br />perceived as being a large problem it could be real expensive. If this is anything, it's <br />probably petroleum. He did not think there would be a problem but it's necessary to find <br />that out for sure. <br /> <br />Motion by Councilmember Beyer and seconded by Mayor Hardin to authorize the cost of <br />the procedure of checking for contamination. <br /> <br />Motion carded. Voting Yes: Mayor Hardin, Councilmembers Beyer, Beahen, Peterson <br />and Zimmerman. Voting No: None. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Beyer to adopt <br />Ordinance g95-15 authorizing the sale of the old public works facility. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen <br />and Zimmerman. Voting No: None. <br /> <br />Case #11: Property Acquisition <br /> <br />City Engineer Sankowski stated that last March, the City Council authorized Improvement <br />Project g95-12 which involved drainage improvement to an area located in Section #22. In <br />May, all drainage improvements outlined in the project feasibility study were performed, <br />with the exception of the installation of two culverts at each end of a pond located on the <br /> <br />City Council/September 12, 1995 <br /> Page 10 of 13 <br /> <br /> <br />
