Lewis property. Mr. Lewis indicated that the swans he raises in the pond were nesting and <br />could not be disturbed until after the cygnets hatched in June. Mr. Jankowski reported that <br />he had been leaving messages on Mr. Lewis' answering machine since mid-June and had <br />not heard anything back from him, until tonight. Mr. Lewis, who has been out of town, <br />has indicated that he obtained the culverts and that he would install them himself. Mr. <br />Jankowski anticipated Mr. Lewis' cooperation but stated he does not have a problem <br />asking for the adoption of the resolution to begin eminent domain proceedings anyway. <br /> <br />Councilmember Beyer stated she thought Council had already adopted a resolution <br />initiating eminent domain proceedings for this project. <br /> <br />Mr. Jankowski explained that Council adopted a resolution authorizing acquisition of <br />easements, not a condemnation resolution. <br /> <br />Councilmember Beyer inquired about not having the easements but commented that the <br />work is done. <br /> <br />Mr. Jankowski replied that was correct because we were given permission to enter onto the <br />property. He stated that several property owners did have concerns about granting <br />easements and he is not certain all will do so. <br /> <br />Discussion ensued about condemnation proceedings and Council directed that Staff should <br />present resolutions pertaining to the remainder of the properties. <br /> <br />Councilmember Beyer commented she would rather acquisitions were done through <br />negotiations instead of through condemnation proceedings. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Beahen to adopt <br />Resolution g95-09-211 authorizing acquisition of property for drainage purposes subject to <br />the City Attorney's review of the legal description. <br /> <br />Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beahen, Beyer <br />and Peterson. Voting No: None. <br /> <br />Case #12: Report from Road and Bridge Committee <br /> <br />City Engineer Jankowski reported that due to lack of time, the Road and Bridge Committee <br />was unable to meet earlier this evening. The Committee intended to review the 1995 Street <br />Maintenance Program. The bids received were higher than the estimate and the <br />assessments to the benefitted parties could be from $6 to $26 higher than projected in the <br />feasibility study and he wanted input from the Road and Bridge Committee pertaining to <br />that. The increase is minimal but the percent would be fairly significant. The other issue <br />was to finaiize the assessment role. Mr. Jankowski stated that one other issue is Project <br />g94-20 - sewer and water to the Deal property. After the utilities were located in the field <br />along Highway #10, we concluded it would be difficult to put the watermain down the <br />front. If it is mn along the railroad tracks, it will result in a net decrease in project cost by <br />$9,000. It would have been good to have fh'e protection along Highway #10 for the nailer <br />court. · <br /> <br />Case #13: Report from Personnel Committee <br /> <br />1) Administrative Services Manager Vacancy <br /> <br />City Administrator Schroeder reported that the Personnel Committee recommended <br />advertising the Administrative Services Manager Vacancy as is with a wage range of <br />$35,919 to $43,988.
