Mr. Jankowsld stated that this is one of the issues discussed at the Road and Bridge
Committee meeting. The Johnston's have their driveway on the County Road but they
have frontage on one or more of the residential streets. Oar policy has been to assess
comer lots a full share when the appropriate frontage received the improvement. In this
case, they would never receive an assessment because they are on the County Road. The
Road and Bridge Committee recommended they should pay a share equal to everyone else
in the subdivision.

Councilmember Peterson inquired if this would be dealt with on a case-by-case basis or if
we would be changing the policy.

Mr. Jankowski stated that in the case where property fronts on residential and MSA streets,
a full assessment should be charged when the improvement gets made to the residential
street. This address fronts on a County Road and a residential street.

A letter received from the Johnston's stated they would be willing to pay 50% of the
assessment, however, they do object to a full assessment.

Motion by Councilmember Peterson and seconded by Councilmember Beyer to amend the
assessment to show that the Johnston's will be paying one-half the amount.

Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen
and Zimmerman. Voting No: None.

Motion by Councilmember Peterson and seconded by Councilmember Beyer to close the
public hearing.

Motion carded. Voting Yes: Mayor Hardin, Councilmembers Peterson, Beyer, Beahen
and Zimmerman. Voting No: None.

The public hearing closed at 7:31 p.m.

Council Business

Mayor Hardin called the regular portion of the City Council meeting back to order at 7:31
p.m.

Motion by Councilmember Zimmerman and seconded by Councilmember Beyer to adopt
Resolution g95-09-228 adopting assessment for Improvement Project//95-09 (Bituminous
overlay Sports Haven and Carol Rose Acres Additions)

Motion carried. Voting Yes: Mayor Hardin, Councilmembers Zimmerman, Beyer, Beahen
and Peterson. Voting No: None.

Mr. Jankowski alerted Council that the same situation as the Johnston's occurs for two
more property owners in//95-10 and also one in//95-05.

Discussion ensued and it was determined that the City should pick up the difference in the
assessments from assessing certain properties 50%.

Motion by Councilmember Peterson and seconded by Councilmember Beyer that
Improvement Project g95-05 assessment be amended so that the similar property as the
Johnston's pays one-half the assessment.

City Council/September 26, 1995
