#4: Land Purchase from Larry Sandness

Hnance Officer Hart explained that Mr. and Mrs. Larry Sandness own the property
immediately west of T.H. #47, between 151st and 149th Lane. When Gorhams Addition
was platted, 40 feet of service road was dedicated to the City, in addition to an additional
17 feet of right~of-way which was dedicated to the State for T.H. #47. Subsequently, the
Sandness' purchased a 60 foot remnant piece along the south side of this parcel, which was
not a part of the Oorham plat, so neither the City nor the State right-of-ways were dedicated
on this piece. The service road has been constructed and maintained over this parcel, and
the City has fights to its continued use because of this. However, the City would not have
any rights to construct utilities through this parcel and it appears likely that sewer, water,
and storm sewer may be needed through his parcel in the near future. Since the Sandness'
recently hooked up to City sewer, conversations with them on resolving this potential
future problem have occurred. They are agreeable to transferring fee title fights to the City
for $1,000 for a parcel 60 feet by 47 feet.

Motion by Mayor Hardin and seconded by Councilmember Beahen to authorize acquiring
this 60 x 47' piece of property from the Sandness' for right-of-way purposes at a cost of
$1,000.

Motion carried. Voting Yes: Mayor Hardin, Councilmembers Beahen, Beyer, Peterson
and Zimmerman. Voting No: None.

05: Assisting Individuals with Hookup Charges to Water and Sewer
Utilities Receiving Availability from Subdivision Extensions

Finance Officer Hart stated that a proposed hookup policy was added to the agenda and
was briefly discussed. It will be brought back at a future date following review by the City
Attorney.

Case #18:

Adopt Resolution Approving Partial Payment to H & M
Asphalt for Improvement Project g95-15 (Construction of
Sanitary Sewer, Watermain, Storm Sewer and Streets to
Service Fox Knoll)

Motion by Councilmember Peterson and seconded by Councilmember Beahen to adopt
Resolution g95-09-233 approving partial payment to H & M Asphalt for Improvement
Project g95-15 (Construction of sanitary sewer, watermain, storm sewer and streets to
service Fox Knoll).

Motion carried.
