Mr. Martinson explained that the fence has to be a concrete wall and if a new facility is <br />constructed a portion of the fence would have to be removed so Mr. Shot has held off on the <br />fence to see what possibilities would be made available by the City. <br /> <br />Councilmember Elvig stated that if in fact there was going to be a venture between the City and <br />the business owner knowing that a person can't even afford to put up a fence and looking for <br />potential grant or TIF funds it would be a bad venture. He felt that at this point they should <br />continue with what was originally agreed to and if they were willing to do that he would possibly <br />consider a 30-day extension to get the fence installed. <br /> <br />Mayor Gamec inquired if it was possible to grant the extension for a short time. <br /> <br />City Attorney Goodrich replied yes, but he also noted that if the extension is denied Mr. Shot <br />could come back and apply for a new conditional use permit. <br /> <br />Mayor Gamec stated that he was leaning towards denying the request. If Mr. Shot wants to come <br />forward with a site plan for a new facility and then follow through with it they may be in <br />agreement, but there have been a lot of unkept promises. <br /> <br />Mr. Martinson replied that he did not have the ability to put that information together between <br />2:45 p.m. and 7:00 when he received the notice of the Planning Commission on the same day the <br />meeting was going to be held. <br /> <br />Mayor Gamec stated that there were promises made by Mr. Shot and the Council has to make <br />sure that things are done as agreed to. <br /> <br />Councihnember Cook stated that it is difficult enough granting a conditional use permit and then <br />extending it for two years and still see nothing is very discouraging. He felt that the Council <br />should deny the request and then if they want to come back with a plan for the property the <br />Council could consider it. <br /> <br />Mr. Martinson stated that if Mr. Shot was present he would explain that he has invested half a <br />million dollars into the property above the purchase price cleaning up the property plus paying <br />four years of back taxes. <br /> <br />Mayor Gamec replied that Mr. Shot knew that when he purchased the property. <br /> <br />Councilmember Cook stated that Mr. Martinson is asking the Council to grant an extension to <br />someone that is making bad business decisions. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to adopt Resolution #03-07-181 <br />adopting Findings of Fact # 0652 relating to a request from St. Paul Terminals for an extension to <br />implement the conditional use permit for a recycling facility. <br /> <br />City Council/July 8, 2003 <br />Page 23 of 30 <br /> <br /> <br />
