Case #2: Request for Variance to Cul-de-sac Length in Chestnut Ridge; Case <br /> of Good Value Homes <br /> <br />Zoning Administrator Frolik stated that Chestnut Ridge was recommended for plat approval with <br />Krypton Street N,W. being constructed as a through street, contingent upon DNR granting a <br />permit to cross wetland #2-114P. Ms. Frolik advised that Good Value Homes has received <br />notification from the DNR that their request for a permit to cross the wetland has been denied. She <br />explained that the developer approached City Council in May for a revision to the final plat to <br />construct Krypton Street N.W. as a cul-de-sac that exceeds the 600 foot minimum length by <br />approximately 800 feet, and City Council directed the developer to approach the Planning <br />Commission for a recommendation on a variance to maximum cul-de-sac length. <br /> <br />City Engineer Jankowski outlined the various proposals submitted to the DNR for accommodating <br />a through street. He advised that the DNR's decision could be appealed, but it would take at least a <br />year with only a slim chance of reversal. He advised that City Attorney Goodrich has <br />recommended obtaining a variance to cul-de-sac length. <br /> <br />The Planning Commission proceeded to review the Findings of Fact. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to accept gl through <br />#14 as presented. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, and Thorud. Voting No: None. Absent: Commissioners LaDue and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to amend #15 to read <br />"That by reason of physical conditions, namely Wetland #2-114P and County Ditch No. 43, strict <br />compliance with the requirements of cul-de-sac lengths will cause exceptional and undue hardship <br />to the development of the Subject Property." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, and Thomd. Voting No: None. Absent: Commissioners LaDue and Terry. <br /> <br />Motion by Commissioner Thorud and seconded by Commissioner Deemer to amend #16 to read <br />"That if granted, the variance will not adversely affect the spirit and intent of the Ramsey Zoning <br />Chapter and Subdivision Design Standards." <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Thorud, Deemer, <br />Hendriksen, and Holland. Voting No: None. Absent: Commissioners LaDue and Terry. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Holland to recommend that City <br />Council adopt the amended findings of fact relating to a request by Good Value Homes for a <br />vm'iance to cul-de-sac length. <br /> <br />Motion carried. Voting Yes: Chairperson Bawden, Commissioners Deemer, Holland, <br />Hendriksen, and Thorud. Voting No: None.
