Absent: Board Member <br /> <br />Motion by Board Member LaDue and seconded by Board Member Terry to adopt Resolution g94- <br />03-049 adopting Findings of Fact #0355, as amended and enlarged upon, relating to Terry <br />Hendriksen's request for a variance to thoroughfare setback requirements at 15631 Ramsey <br />Boulevard N.W. <br /> <br />Motion carried. Voting Yes: <br />Thomd. Voting No: None. <br />Bawden. <br /> <br />Chairperson Deemer, Board Members LaDue, Terry, Holland, and <br />Abstain: Board Member Hendriksen. Absent: Board Member <br /> <br />The Board of Adjustment proceeded to review the terms of the variance. <br /> <br />Mr. Hendriksen stated he is in agreement with the terms. <br /> <br />Chairperson Deemer inquired about specific dimensions of the addition, and Mr. Hendriksen <br />advised him the addition will be approximately 20 feet by 20 feet. <br /> <br />Motion by Board Member LaDue and seconded by Board Member Holland to adopt Resolution <br />g94-03-050, as presented, approving the issuance of a variance to Terry Hendriksen at 15631 <br />Ramsey Boulevard N.W. and declaring terms of same. <br /> <br />Motion carried. Voting Yes: <br />Thorud. Voting No: None. <br />Bawden. <br /> <br />Chairperson Deemer, Board Members LaDue, Holland, Terry, and <br />Abstain: Board Member Hendriksen. Absent: Board Member <br /> <br />Board Member Hendriksen resumed his seat on the Board of Adjustment. <br /> <br />Case 02: <br /> <br />Request for a Variance to Construct an Accessory Structure that Will <br />Be Nearer the Front Property Line than the Principal Structure; Case <br />of Ben Deemer <br /> <br />Chairperson Deemer is now present as a citizen, therefore Vice Chairperson LaDue became acting <br />Chairperson. <br /> <br />Zoning Administrator Frolik stated that Ben Deemer is proposing to construct a 1,500 square foot <br />accessory sl~ucture that will be nearer the front property line than his home at 14501 Sunfish Lake <br />Boulevard N.W. (C.S.A.H. #57). She explained that the hardship for the variance is that the <br />original builder of the home created a 300 foot front yard setback by the placement of the home. <br />She added that in addition to substantial amounts of mature tree growth and sharply declining <br />property in the vicinity of the home, construction of the accessory structure in more appropriate <br />locations is also prohibited by the location of the well, septic and drainfield system, and an <br />alternate drainfield area. <br /> <br />Board Member Terry inquired why the previous driveway was vacated, and Mr. Deemer replied <br />that the driveway went onto a private easement that was not on his property. <br /> <br />Board Member Terry inquired if it was the intention of the home builder to bring the driveway out <br />the front of the house, and Mr. Deemer stated he believed that was the intention. <br /> <br />The Board of Adjustment proceeded to review the Findings of Fact. <br /> <br />Board of Adjustment/March 17, 1994 <br /> Page 3 of 12 <br /> <br /> <br />
