Motion by Board Member Holland and seconded by Board Member Thorud to accept gl through <br />#6 as presented. <br /> <br />Motion carried. Voting Yes: Vice Chairperson LaDue, Board Members Holland, Thorud, <br />Hendriksen,'andTerry. Voting No: None. Abstain: Chairperson Deemer. Absent: Board <br />Member Bawden. <br /> <br />Vice Chairperson LaDue inquired about Mr. Deemer's total square footage of accessory buildings. <br /> <br />Ms. Frolik stated that it would be approximately 2400 square feet which is in compliance with City <br />Code. <br /> <br />Mr. Deemer stated that, although it is not a concern at this time, the total of 3,664 square feet <br />mentioned in Finding #7 is inaccurate in that it was computed for only his property on one side of <br />the road, not the entire parcel. <br /> <br />Ms. Frolik stated she was setting a policy wherein the square footage for accessory buildings is <br />computed on only the contiguous property. Therefore if an owner subdivides in the future, the <br />newly created lot is not prohibited by what was put on the parcel as a whole. <br /> <br />Vice Chairperson LaDue noted that this disjointed parcel might be of some value in the future, and <br />this policy would be advantageous for that purpose. <br /> <br />Mr. Deemer stated that the property is legally one parcel, under one P.I.N., and is approximately <br />eight acres in size. <br /> <br />Board Member Terry stated that if someone owns a 10-acre parcel, they are granted the rights due a <br />10-acre pan:el. <br /> <br />Board Member Hendriksen agreed and stated that the City cannot assume a property owner will <br />exercise their right to subdivide. <br /> <br />Ms. Frolik explained that the larger a parcel, the larger the garage and accessory structure <br />allotment. She stated that a 10-acre parcel divided by a road becomes two 5-acre lots, and she <br />questioned whether it would be aesthetically appropriate to put 10 acres worth of accessory <br />structure on a 5-acre lot and also diminish all garage space on the other 5-acre parcel that someday <br />might be a separate, buildable parcel of record. <br /> <br />The Board of Adjustment decided to discuss this further during Board Input. <br /> <br />Motion by Board Member Holland and seconded by Board Member Hendriksen to amend #2 to <br />read "That the subject property is zoned R-1 Rural Residential and is approximately eight (8) acres <br />in size;..." <br /> <br />Motion carried. Voting Yes: Vice Chairperson LaDue, Board Members Holland, Hendriksen, <br />Terry, and Thorud. Voting No: None. Abstain: Chairperson Deemer. Absent: Board Member <br />Bawden. <br /> <br />Motion by Board Member Holland and seconded by Board Member Terry to accept #7 through <br />#17 as presented and to amend #15 through #17 to the positive. <br /> <br />Further Discussion: Board Member Terry suggested inserting the word "minimum" before "3,664 <br />square feet" in #7. <br /> <br />Board of Adjustment/March 17, 1994 <br /> Page 4 of 12 <br /> <br /> <br />
