Case #$: Consider Conditional Use Permit for Lots 2, 3 and 4, Block 4,
Gateway North Industrial Park Plat #2; Case of Danny's
Tranny's, Inc.

Zoning Administrator Frolik stated that City Council conducted a public hearing on
December 14, 1993, to review conditional use permit compliance and directed City Staff to
draft f'mdings of fact. Since the public hearing, the City has received letters from both Mr.
Karst and his plant manager, Sam Brady, stating their commitment to construct the building
and conduct operations in accordance with the conditional use permit. Ms. Frolik stated
she did a drive-by inspection of Danny's Tranny's and it was difficult to tell what was there
because of the snow cover. She felt there was not much change from December 14, 1993;
however, there was a marked improvement from September to December. Mr. Karst has
not added 'to the debris since December.

Danny Karst, owner of Danny's Tranny's, stated that the City has not conducted a walk-
through inspection.

Councilmember Peterson inquired of Mr. Karst if the dates set in the conditional use permit
were realistic.

Mr. Karst stated that they had "run into some problems with the banking", but that he
hoped to '!break ground by spring".

Councilmember Beyer stated she could sympathize with Mr. Karst's problems but inquired
why Mr. Karst didn't come forward to let the City know what was going on.

Mr. Karst stated he was running around doing the paperwork so he wasn't around to see
what was going on at his business.

Councilmember Beyer suggested forming a committee of a couple of the Councilmembers
and Staff to meet with Mr. Karst and his employees to make sure they will comply with the
CUP.

Councilmembers Zimmerman and Beyer offered to be on the committee.

Motion by Councilmember Peterson and seconded by Councilmember Hardin to table the
discussion of the conditional use permit until the committee consisting of Councilmembers
Beyer and Zimmerman, City Administrator Schroeder and Zoning Administrator Frolik has
had a chance to meet with Mr. Karst. They will report on the meeting at the January 25,
1994 Council meeting.

Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Hardin, Beyer
and Zimmerman. Voting No: None.

Case g6: Adopt Ordinance Conveying Title to Lots 1 Through 3, Block
5, Amber Ridge to Gor-Em, LLC

City Attorney Goodrich stated that the adoption of this ordinance resolves the title issue
relating to Lots 1 through 3, Block 5, Amber Ridge.

Motion by Councilmember Zimmerman and seconded by Councilmember Hardin to adopt
Ordinance g94-01 conveying title to Lots 1 through 3, Block 5, Amber Ridge to Got-Em,
LLC.

City Council/January 18, 1994
