Case #$: Adopt Proposed Ordinance Vacating Drainage and Utility <br /> Easements along the East Border of Lot 2, Block 1, and the <br /> West Border of Lot 1, Block 1, of Trott Brook Ridge Addition <br /> <br />This case Was tabled until Staff can reach the developer regarding a second easement. <br /> <br />Case <br /> <br />Consider Conditional Use Permit for Lots 2, 3 and 4, Block 4, <br />Gateway North Industrial Park Plat #2; Case of Danny's <br />Tranny's, Inc. <br /> <br />Zoning Administrator Fmlik stated that on January 18, 1994, the City Council tabled action <br />on this case and directed Councilmembers Beyer and Zimmerman, City Administrator <br />Schroeder and Zoning Administrator Frolik to meet with Mr. Karst and report back to City <br />Council with a recommendation for action on this date. <br /> <br />Councilmember Zimmerman reported that they had met with Mr. Karst and Mr. Brady. It <br />appears Mr. Karst will be getting financing by the end of March for his proposed <br />improvements. Councilmember Zimmerman recommended that Mr. Karst's CUP remain <br />in effect at least until the end of March. <br /> <br />Councilmember Beyer agreed that Mr. Karst's CUP should not be revoked. <br /> <br />Mayor Gilbertson and Councilmember Hardin expressed concern about allowing Mr. Karst <br />to continue his CUP. <br /> <br />Councilmember Peterson questioned what would happen if the CUP was revoked. <br /> <br />Ms. Frolik stated that the City Code doesn't give a time line once the CUP is ended; <br />therefore; Council would have to decide how many days Mr. Karst has to cease activity on <br />Lots 2, 3, and 4. <br /> <br />Councilmember Beyer stated that the original CUP granted to Mr. Karst gave him until <br />June 1, 1994, to have all site improvements completed and dates were discussed at the <br />meeting with Mr. Karst. She suggested it would be inappropriate to take the CUP away <br />before June 1, 1994. <br /> <br />Councilmember Hardin pointed out that Mr. Karst has been in violation of his CUP; <br />therefore, it could be revoked. <br /> <br />Councilmember Peterson added that Mr. Karst continues to violate his CUP. <br /> <br />Councilmember Zimmerman expressed a concern that some of the violation repons may be <br />false. <br /> <br />Mayor Gilbenson stated that the junk on the property is a violation and that the City is <br />constantly going through these same problems with Mr. Karst. <br /> <br />The CoUncil proceeded to review the Findings of Fact. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Hardin to adopt <br />Resolution g94-01-013 adopting Findings of Fact g0351 relating to compliance with terms <br />of the co0difional use permit for Danny's Tranny's on Lots 2, 3, and 4, Block 4, Gateway <br />North Industrial Park Plat #2. <br /> <br />City Council/January 25, 1994 <br /> Page 7 of 9 <br /> <br /> <br />
