Voting No: None. <br /> <br />Case #4: Request for a Conditional Use Permit for a Home Occupation; <br /> Case of Robert and Susan Bowman <br /> <br />Zoning Administrator Frolik stated that Robert and Susan Bowman of 14450 Bowers Drive <br />N.W. have applied for a conditional use permit for a home occupation. The Bowman's <br />repair electronic automobile equipment for resale. The Planning Commission conducted a <br />public hearing on February 1, 1994, and there were several written and verbal comments <br />submitted' in opposition of the Bowman's request. Mr. Bowman has been conducting the <br />business in his home for three to four years and the neighbors feel that it has grown to a <br />point where it would be more appropriately located in a commercial district. The Planning <br />Commission and City Staff are recommending denial of the request for a home occupation. <br />City Stafflis recommending that Mr. Bowman be given until December 31, 1994, to bring <br />his property into compliance with City Code and to cease all commercial activity at 14450 <br />Bowers Drive N.W. Ms. Frolik stated that hazardous waste was mentioned as the <br />Bowman's go through about one gallon of lacquer a week and Anoka County will be <br />talking with Mr. Bowman regarding disposal practices. <br /> <br />Karen Trushenski, 14533 Bowers Drive N.W., Ramsey, inquired about what has been <br />done with~ the lacquer in the past and added that Mr. Bowman never addressed that issue. <br />She stated she is concerned about a home business being on a quiet dead-end street. She <br />felt that a. $400,000 business has no place in a residential neighborhood. She requested <br />that Council not extend the Bowman's CUP for a year. She felt that would be like <br />rewarding them for breaking the law for three and one-half years. <br /> <br />Anna Tolknen, 14503 Bowers Drive N.W., Ramsey, stated she lives across the street from <br />the Bowmans and that she is very concerned about the solvents. She wondered about the <br />private wells, septic systems, and the Mississippi River, and asked who would be <br />responsible if these are contaminated. She stated she expects protection from this type of <br />thing. She inquired what would happen if the Bowman's do not find a suitable spot by <br />December 1994. <br /> <br />City Attorney Goodrich stated that the City could then seek a court order to have the <br />business ceased. <br /> <br />Ms. Tolknen inquired what the Bowman's have been doing with the lacquer in the past. <br /> <br />Ms. Frolik stated that she did not know and that's what Anoka County was going to be <br />investigating. <br /> <br />Council completed the review of the findings of fact. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Zimmerman to adopt <br />Resolution g94-02-038 adopting the negative Findings of Fact g0353 relating to a request <br />for a home occupation permit at 14450 Bowers Drive N.W. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Peterson, Zimmerman, <br />Beyer and Hardin.
