He <br />stated there are a number of families who were not living in the area in 1985 so they did not <br />have a saylabout what happened back then. <br /> <br />Mayor Cdlbertson stated that the new residents should have realized what shape their road <br />was in. <br /> <br />Councilmcmber Peterson stated that many of the people were opposed to either sealcoating <br />or overlaying. <br /> <br />Mr. Benson stated that it was not mentioned that the City would not participate when the <br />next improvement was done. <br /> <br />Councilmember Peterson stated that the City did not participate in the cost until 1990. <br /> <br />Mr. Benson stated he moved here in 1982. At that time the road was in bad repair and he <br />suggested ithat maybe it was incorrectly built. When the initial sealcoating was proposed, <br />the road ~vas in too bad a shape for it to do any good. Now the road is in worse shape and <br />he felt the,City should participate in the cost. He felt that it was not fair to the people who <br />did not live in the area in 1985. <br /> <br />Luann Wedl, 16012 Xenolith Street N.W., Ramsey, stated she moved to her house in <br />1980 and ,the road had potholes at that time. She said there was never a mention of a <br />penalty if an improvement project was defeated. She stated that the taxes she pays should <br />pay for her half of the assessment. <br /> <br />Mayor Gi!bertson reminded her that if the project would have been done in 1985, she <br />would have had to pay 100 percent at that time too. <br /> <br />Mr. Benson inquired if the road would have to be tom up if it is in really bad condition. <br /> <br />Mr. Jankowski stated that if Class Five gets mixed in with the subsoil, it may have to; <br />however, he felt that the majority of the road is going to be okay to overlay. <br /> <br />Mr. Benson stated "then we should not have failure right away" to which Mr. Jankowski <br />agreed. <br /> <br />Mr. Benson then inquired of Council if they were considering the cost-share to which <br />Councilmembers Peterson and Zimmerman answered that they were not. <br /> <br />Motion by Councilmember Zimmerman and seconded by Councilmember Hardin to close <br />the public hearing. <br /> <br />Motion carried. Voting Yes: Mayor Gilbertson, Councilmembers Zimmerman, Hardin, <br />Beyer and Peterson. Voting No: None. <br /> <br />The public hearing adjourned at 8:32 p.m. <br /> <br />COUNCIL BUSINESS <br /> <br />Case #16: Request for Final Plat Approval of Chestnut Ridge; Case of <br /> John Peterson, Good Value Homes <br /> <br />City Engineer Jankowski stated that Mr. John Peterson, Good Value Homes, is requesting <br />final plat approval of Chestnut Ridge. He is proposing to install the streets, sewer and <br />water as a private development project with no financial participation on the part of the <br />City Council/March 22, 1994 <br /> Page 10 of 14 <br /> <br /> <br />
